IN THE CASE OF:
BOARD DATE: 25 October 2011
DOCKET NUMBER: AR20110006851
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Valorous Unit Award (VUA).
2. The applicant states that at the time of his separation, his unit, 2nd Battalion, 15th Field Artillery Regiment, was in the process of review for receipt of the VUA.
Since then, his unit was awarded the VUA and he desires to have this award added to his DD Form 214.
3. The applicant provides:
* his DD Form 214
* an extract from the U.S. Army Human Resources Command Internet website
CONSIDERATION OF EVIDENCE:
1. The applicant's record shows he was appointed as a Reserve commissioned officer of the Army in the rank of second lieutenant on 15 May 2005 and ordered to active duty on 14 August 2005. He was promoted to first lieutenant on 14 February 2007.
2. His DA Form 4037 (Officer Record Brief) shows he was assigned to Headquarters and Headquarters Battery, 2nd Battalion, 15th Field Artillery Regiment, from 11 March 2006 to 14 August 2007. This form also shows he completed a 12-month deployment to Iraq on 28 July 2007.
3. His DA Form 67-9 (Officer Evaluation Report) rendered for the period 26 January 2006 through 25 January 2007 also shows he was assigned to Headquarters and Headquarters Battery, 2nd Battalion, 15th Field Artillery Regiment, and he deployed to Iraq during the period of the report.
4. His DD Form 214 shows he was honorably discharged on 13 August 2008. Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) does not show award of the VUA.
5. Department of the Army General Orders Number 2011-03, dated 13 May 2011, show the applicant's unit was awarded the VUA for extraordinary heroism while engaged in military operations during the period 1 March 2006 to 1 August 2007.
6. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. This regulation establishes standardized policy for the preparation of the DD Form 214. It states to list awards and decorations for all periods of service in item 13 of the form.
DISCUSSION AND CONCLUSIONS:
The evidence clearly shows the applicant was assigned to Headquarters and Headquarters Battery, 2nd Battalion, 15th Field Artillery Regiment, during the period of time for which the unit was awarded the VUA. Therefore, he is entitled to have this unit award shown on his DD Form 214.

The applicant requests that his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected by showing both units he served in while in Vietnam. Accordingly, it appears his DD Form 214 properly reflects his last unit of assignment before he was REFRAD and there appears to be no basis for granting his request to add an additional unit to his DD Form 214. Therefore, the Board determined the overall merits of this case are insufficient as a basis for...
