IN THE CASE OF:
BOARD DATE: 8 November 2011
DOCKET NUMBER: AR20110006455
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests his father's military records be corrected to show he was awarded the American Campaign Medal.
2. The applicant states his father, a deceased former service member (FSM), spent 1 year in the United States from 9 March 1945 to 25 October 1946.
3. The applicant provides an excerpt from a certificate of live birth and his father's certificate of death.
CONSIDERATION OF EVIDENCE:
1. The FSM's military records could not be located and are presumed to have been destroyed in the fire at the records repository at St. Louis, Missouri, in 1973. However, the records provided by the applicant are sufficient to consider his request.
2. The FSM's available military records show he was inducted into the Army on 9 March 1945 and entered active duty that date, was awarded the military occupational specialty of squad leader, and was promoted to the rank of staff sergeant. He was honorably discharged on 25 October 1946.
3. The WD AGO Form 53-55 (Enlisted Record and Report of Separation Honorable Discharge) he was issued, item 36 (Service Outside Continental U.S. and Return), shows he departed the United States on 22 August 1945 for the Pacific Theater of Operations, and did not return to the United States until 16 September 1946. As such, he was in the United States:
To 1945 08 22 (22 August 1945)
From 1945 03 09 (9 March 1945)
05 13
+____1(1 day inclusive)
05 14 (5 months and 14 days)
To 1946 10 25 (date of separation)
From 1946 09 16 (date of return to the United States)
01 09
+ ___1 (1 day inclusive
01 10 (1 month and 10 days)
05 14 (5 months and 14 days)
+ 01 10 (1 month and 10 days)
= 06 24 (6 months and 24 days)
4. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, for award of the American Campaign Medal. This campaign medal is awarded for qualifying service in the American Theater between 7 December 1941 and 2 March 1946. Qualifying service includes permanent assignment outside the continental United States, duty as a crewmember aboard a vessel sailing ocean waters for 30 consecutive or 60 nonconsecutive days, or duty outside the continental United States as a passenger or in a temporary duty status for 30 consecutive or 60 nonconsecutive days, or active combat against the enemy and was awarded a combat decoration or furnished a certificate by a corps commander or higher, or service within the continental United States for an aggregate period of one year.
DISCUSSION AND CONCLUSIONS:
Since the FSM was not assigned to a unit in the continental United States for an aggregate period of one year, and there is no evidence he met any of the other criteria for award of the American Campaign Medal, he was not entitled to the American Campaign Medal.
BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
___X___ ___X____ ___X____ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.
