THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active duty) for the period ending 10 October 2003 to show award of the:

* Afghanistan Campaign Medal (ACM)
* Global War on Terrorism Service Medal (GWOTSM)
* Global War on Terrorism Expeditionary Medal (GWOTEM)
* Presidential Unit Citation (PUC)

2.  The applicant states, in effect, that he is missing some awards on his
DD Form 214.  He states he went to Afghanistan in support of Operation Enduring Freedom (OEF) and his unit, Company C, 307th Forward Support Battalion (FSB), 82nd Airborne Division, earned a PUC.  That and the Global War on Terrorism medals are not on his DD Form 214.

3.  The applicant provides no additional documentation.

CONSIDERATION OF EVIDENCE:

1.  With prior active duty enlisted service as an infantryman from 3 January 1991 through 2 August 1993, he was honorably discharged to enter the Reserve Officers' Training Corps.  He subsequently served as a U.S. Army Reserve captain, Dental Corps (DC) from 11 October 1999 through 10 October 2003.


2.  He was honorably discharged on 10 October 2003 for miscellaneous/general reasons.  He completed 4 years of creditable active service during this period.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows the:

* Bronze Star Medal
* Meritorious Service Medal
* Army Achievement Medal
* National Defense Service Medal (NDSM)
* Army Service Ribbon
* Expert Infantryman Badge
* Combat Medical Badge
* Parachutist Badge

3.  The Defense Finance and Accounting Service (DFAS) confirmed the applicant received hostile fire/imminent danger pay (HF/IDP) and combat zone tax exclusion (CZTE) for service in Afghanistan from 6 January 2003 through 4 June 2003.

4.  The applicant's Interactive Personnel Electronic Records Management System (iPERMS) files contain documents showing he served in Afghanistan with C Company, 307th Forward Support Battalion [now Brigade Support Battalion], 82nd Airborne Division.

5.  Section I (Assignment Information) of his Officer Record Brief (ORB) shows he returned from Afghanistan in June 2003 after serving 6 months at the overseas location.

6.  Army Regulation 600-8-22 (Military Awards) sets forth Department of the Army criteria, policy and instructions concerning individual military awards, the Army Good Conduct Medal, service medals and service ribbons, combat and special skill badges and tabs, unit decorations, and trophies and similar devices awarded in recognition of accomplishments.  It provides:

	a.  The NDSM is awarded for honorable active service for any period between 27 July 1950 and 27 July 1954, 1 January 1961 and 14 August 1974, 2 August 1990 and 30 November 1995, and 11 September 2001 and a date to be determined.  Second and subsequent awards of the NDSM are denoted by a bronze service star affixed to the medal.


	b.  The ACM is awarded to members who have served in direct support of OEF.  The area of eligibility (AOE) encompasses all the land area of the country of Afghanistan and all air spaces above the land area.  The period of eligibility is on or after 24 October 2001 to a future date to be determined by the Secretary of Defense or the cessation of OEF.  A bronze service star is authorized for wear with this medal for participation in each credited campaign.  Approved designated Afghanistan campaigns are:

* Liberation of Afghanistan (11 September 2001 - 30 November 2001)
* Consolidation I (1 December 2001 - 30 September 2006)
* Consolidation II (1 October 2006 - date to be determined

	c.  The GWOTSM is authorized for award to members of the Armed Forces of the United States who have participated in Global War on Terrorism operations outside of the AOE designated for award of the GWOTEM, ACM, or Iraq Campaign Medal (ICM).  All Soldiers on active duty, including Reserve Component Soldiers mobilized or National Guard Soldiers activated, on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the GWOTSM.  

	d.  The GWOTEM is authorized for award to members of the Armed Forces of the United States who deployed abroad for service in the Global War on Terrorism operations on or after 11 September 2001 to a date to be determined.

	e.  The PUC is awarded for extraordinary heroism in action.  A unit must display such gallantry, determination, and esprit de corps in accomplishing its mission as would warrant award of the Distinguished Service Cross to an individual.

7.  Army Regulation 600-8-22 further states under no condition will personnel or units receive the ACM, the GWOTEM, GWOTSM, the ICM, or the Armed Forces Expeditionary Medal for the same action, time period, or service.

DISCUSSION AND CONCLUSIONS:

1.  Evidence shows the applicant served during a qualifying period of service in Afghanistan for entitlement to the ACM with 1 bronze service star and the GWOTSM.  Therefore, he is entitled to correction of his DD Form 214 to show these awards.

2.  However, he is not entitled to a GWOTEM as that would duplicate his service for which he is entitled to the ACM.  Therefore, there is no basis for granting this portion of his request.

3. The applicant received the NDSM for his enlisted service from 1991 to 1993.  He is also entitled to a second NDSM for his most recent period of active service.  Therefore, his DD Form 214 should be corrected to show the NDSM with            1 bronze service star.

4.  No general orders could be located which awarded the PUC to his unit for service in Afghanistan.  Therefore, there is no basis for adding this unit award to his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  deleting from item 13 of his DD Form 214 for the period ending 10 October 2003 the National Defense Service Medal, and

	b.  adding to item 13 of his DD Form 214 for the period ending 10 October 2003 the:

* National Defense Service Medal with one bronze service star
* Afghanistan Campaign Medal with one bronze service star
* Global War on Terrorism Service Medal

2.  The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.  As a result, the Board recommends 


denial of so much of the application that pertains to the Global War on Terrorism Expeditionary Medal and the Presidential Unit Citation.
