THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his earlier request for correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show:

* His deployment to Bosnia from September 1998 to 20 March 1999
* Award of the Armed Forces Expeditionary Medal
* Award of the NATO Medal

2.  The applicant states he deployed to Bosnia-Herzegovina in support of Operation Joint Forge during the first week of September 1998.  He was assigned to B Company, 115th Forward Support Battalion (FSC), 1st Cavalry Division.  He redeployed on or about 20 March 1999.  

3.  The applicant provides:

* His DD Form 214
* Sergeant (SGT) LMG's DD Form 214
* Private (PV2) LDB's DD Form 214
* Specialist (SPC) LME's certificate for award of the NATO Medal
* Three certificates showing three awards of the Army Achievement Medal (AAM)
* Orders awarding him the Army Good Conduct Medal




CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20080016803, on 23 January 2009.

2.  The applicant submitted three certificates showing three awards of the Army Achievement Medal and other individuals' DD Forms 214 or award certificates, which were not previously reviewed by the ABCMR; therefore, they are considered new evidence and, as an exception to policy, warrant consideration by the Board.

3.  The applicant enlisted in the Regular Army on 2 January 1996 and held military occupational specialty 92Y (Unit Supply Specialist).  He attained the rank/grade of specialist/E-4 and he was assigned to B Company, 115th FSC, 1st Cavalry Division, Fort Hood, TX.

4.  Item 5 (Overseas Service) of his DA Form 2-1 (Personnel Qualification Record) does not show he completed any overseas service.

5.  He was honorably released from active duty on 22 April 2000 and he was transferred to the U.S. Army Reserve Control Group (Reinforcement).  His DD Form 214 shows he completed 4 years, 3 months, and 21 days of total active service.  This form also shows the following entries:

* Item 12f (Foreign Service) - "0000  00  00"
* Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) shows the Army Lapel Button, Good Conduct Medal, National Defense Service Medal, Army Service Ribbon, and the Marksman Marksmanship Qualification Badge with Rifle Bar
* Item 18 (Remarks) does not show his deployed service to Bosnia

6.  Information obtained from Defense Finance and Accounting Service, Indianapolis, IN, confirms the applicant received hostile fire/imminent danger pay (HF/IDP) from 1 September 1998 to 31 March 1999 for service in Bosnia.

7.  He provides:

	a.  Permanent Orders Number 350-1, issued by Headquarters, 15th FSC, Fort Hood, TX, on 23 December 1999, awarding him the AAM for meritorious service.

	b.  Permanent Orders Number 216-01, issued by Headquarters, 15th FSC, Fort Hood, TX, on 4 August 1998, awarding him the AAM for meritorious service achievement while training at Fort Polk, LA .

	c.  Permanent Orders Number 079-024, issued by Headquarters, 15th FSC, Fort Hood, TX, on 20 March 1997, awarding him the AAM for outstanding performance of duty.

	c.  Permanent Orders Number 350-1, issued by Headquarters, 15th FSC, Fort Hood, TX, on 23 December 1999, awarding him the AAM for outstanding performance during a warfighter exercise at Fort Hood, TX.

	d.  SGT LMG's DD Form 214, dated 2 December 1999.  This form shows at the time of her separation, SGT LMG was assigned to Headquarters and Headquarters Company, 15th FSC.  She completed 6 months and 5 days of foreign service and she was authorized both the Armed Forces Expeditionary Medal and the NATO Medal.

	e.  PV2 LDB's DD Form 214, dated 29 September 1999.  This form shows at the time of his separation, PV2 LDB was assigned to Company B, 15th FSC.  He completed 6 months and 25 days of foreign service and he was authorized both the Armed Forces Expeditionary Medal and the NATO Medal.

	f.  SPC LME's award certificate showing she was awarded the NATO Medal for service with NATO In support of Operation Joint Forge from September 1998 to March 1999. 

7.  Army Regulation 600-8-22 (Military Awards) states:

	a.  The Armed Forces Expeditionary Medal for qualifying service after 1 July 1958 in U.S. military operations, U.S. operations in direct support of the United Nations, and U.S. operations of assistance for friendly foreign nations.  Qualifying service for this award includes participation in the Former Republic of Yugoslavia for Operations Joint Endeavor and Joint Guard from 1 June 1992 to 20 June 1998 (only for participants deployed to Bosnia-Herzegovina and Croatia).

	b.  The NATO Medal was authorized by the Secretary-General of the North Atlantic Treaty Organization for specific NATO operations.  The Secretary of Defense may approve acceptance and wear by U.S. service members who meet the criteria specified by the Secretary-General of NATO.  Acceptance of the NATO Medal has been approved for U.S. military personnel who serve under NATO command or operational control in direct support of NATO operations in the former Republic of Yugoslavia from 1 July 1992 through a date to be determined.

8.  Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214.  Chapter 2 contains guidance on the preparation of the DD Form 214.  It states that for item 12f, enter the total amount of foreign service completed during the period covered by the DD Form 214.  Additionally for an active duty Soldier deployed with his or her unit during their continuous period of active service, the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)" will be entered in item 18.

DISCUSSION AND CONCLUSIONS:

1.  With respect to his foreign service, he states he served in Bosnia from September 1998 to 20 March 1999.  This period of service is consistent with his pay records which show he received HF/IDP for service in Bosnia from 1 September 1998 to 31 March 1999.  Therefore, he is entitled to correction of his DD Form 214 to show this foreign service in items12f and 18 of his DD Form 214.

2.  The evidence of record shows he served a qualifying period in Bosnia during Operation Joint Forge for award of the Armed Forces Expeditionary Medal which is not shown on his records; therefore, he is entitled to the Armed Forces Expeditionary Medal and correction of his DD Form 214 to show this award.

3.  The evidence of record shows he was awarded three awards of the AAM, none of which is shown on his DD Form 214.  Therefore, he is entitled to correction of his DD Form 214 to show these awards.

4.  With respect to the NATO Medal, this award is not an Army award.  It is issued by the Secretary General of NATO.  The Board is not authorized to award the NATO Medal.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* deleting from item 12f of his DD Form 214 the entry "0000  00  00" and replacing it with the entry "0000  06  20"
* adding to item 13 of his DD Form 214 the Army Achievement Medal (3rd Award) and the Armed Forces Expeditionary Medal (Bosnia)
* adding to item 18 of his DD Form 214 the entry "SERVICE IN BOSNIA FROM 19980901 - 19990320"

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to the NATO Medal.
