		BOARD DATE: 30 August 2011

		DOCKET NUMBER: AR20110004251

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests reconsideration of the Army Board for Correction of Military Records (ABCMR) denial to add his award of the Silver Star to his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge).

2. The applicant states he has located the general orders awarding him the Silver Star.

3. The applicant provides the general orders awarding him the Silver Star.

CONSIDERATION OF EVIDENCE:

1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the ABCMR in Docket Number AR20100017616 on 11 January 2011.

2. Headquarters, 1st Cavalry Division (Airmobile) General Orders Number 7315, dated 3 July 1968, are new evidence which requires his case to be reconsidered by the ABCMR.

3. He was inducted into the Army of the United States on 6 December 1966. He completed basic combat and advanced individual training and was awarded military occupational specialty 11C (Infantry Indirect Fire Crewman).

4. He was assigned to Company C, 2nd Battalion, 7th Cavalry, 1st Cavalry Division in the Republic of Vietnam from 6 June 1967 to 4 June 1968.
5. The orders he submitted show he was awarded the Silver Star for gallantry in action on 4 April 1968 while engaged in military operations involving conflict with an armed hostile force in the Republic of Vietnam.

6. On 6 September 1968, he was released from active duty. He completed
1 year, 9 months, and 1 day of active service that was characterized as honorable. Item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 does not show he was awarded the Silver Star.

DISCUSSION AND CONCLUSIONS:

The orders show he was awarded the Silver Star. Therefore, it is appropriate to add this award to his DD Form 214.

BOARD VOTE:

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20100017616, dated 11 January 2011. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending item 24 of his DD Form 214 to add the Silver Star.

However, there is no evidence of record and he provided no evidence that shows he was assigned to these units during this time frame. The evidence does show he was assigned to Troop B, 7th Squadron, 1st Air Cavalry, on 11 December 1968 when his redeployment orders were published, but there is no evidence that unit was cited for the Republic of Vietnam Gallantry Cross with Palm Unit Citation on that date. The applicant served in Vietnam during a qualifying period; therefore, he is entitled...
