THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests his social security number (SSN) on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected to show SSN ***-**4379 instead of SSN ***-**4378.

2.  The applicant states the Army never got his SSN correct, which is now affecting his social security benefits.

3.  The applicant provides:

* his DD Form 214
* an SSN printout from the Social Security Administration
* his SSN card
* a DA Form 1341 (Allotment Authorization)

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  He was inducted into the Army of the United States on 2 November 1966.  He completed basic combat and advanced individual training and he was awarded military occupational specialty 71B (Clerk Typist).  His DD Form 47 (Record of Induction) indicates he was assigned Army Service Number (ASN) 
"US ** *** 150."

3.  A DD Form 398 (Statement of Personal History) shows he entered his SSN as ***-**-4379.  He signed this form on 19 October 1966.

4.  A DA Form 3027 (U.S. Army Request for National Agency Check), dated 
7 November 1966, shows he used SSN ***-**-4379 and ASN "US ** *** 150."

5.  Item 9 (SSN) of his DA Form 41 (Record of Emergency Data) shows his SSN as ***-**-4379.

6.  During the period the applicant served in the military, Soldiers were identified by their ASN.  The Army discontinued using the ASN as an identifier and began using the SSN on 1 July 1969.  A limited number of documents in his Military Personnel Records Jacket (MPRJ) identify him using SSN ***-**-4378 as well as his ASN.  However, the majority of documents contained in his MPRJ identify him only by his military ASN.

7.  On 16 September 1968, he was released from active duty.  His DD Form 214 shows his ASN as US ** *** 150 and his SSN as ***-**-4378.

8.  A DA Form 1341, dated 2 November 1966, started an allotment to his father. His SSN is clearly shown as ***-**-4379 on this document.

9.  The printout, dated 15 February 2011, his SSN card, and his Honorable Discharge Certificate, dated 1 November 1972, show his SSN as ***-**-4379.

DISCUSSION AND CONCLUSIONS:

1.  During the period he served in the Army, Soldiers were identified by their ASN.  A limited number of documents in his MPRJ identified him using both his ASN and SSN ***-**-4378.  However, the request for a National Agency Check identified him using his ASN and SSN ***-**-4379.

2.  His DD Form 398 and DA Form 41 both show his SSN as ***-**-4379.  Both of these forms are signed by the applicant.  The DA Form 1341, a pay document, shows his SSN as ***-**-4379

3.  The preponderance of substantiative evidence in this case shows when he served in an active duty status he used SSN xxx-xx-4379.  Therefore, it would be appropriate to change item 3 of his DD Form 214 effective 16 September 1968 to show this SSN.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the entry in item 3 of his DD Form 214 and adding SSN xxx-xx-4379.
