THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his request for award of the Combat Infantryman Badge.

2.  The applicant states the Board's previous denial of his request was based on the absence of evidence showing he held an infantry military occupational specialty (MOS).

3.  The applicant provides several sets of orders showing his primary MOS was 11B4P (Airborne Infantryman).  He also provides a statement, dated 18 July 2010, from Colonel Rxxxx Rxxxxxx, Infantry, (Retired), who attests he was the applicant's company commander in Vietnam and states the applicant held MOS 11B4P.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20090015430 on 18 March 2010.






2.  The applicant provides:

* an 18 July 2010 letter from his former company commander, now a retired Infantry colonel
* Special Orders Number 160, Headquarters, 1st Brigade, 101st Airborne Division, Vietnam, dated 9 June 1966
* Special Orders Number 98, Headquarters, 1st Brigade, 101st Airborne Division, Vietnam, dated 7 April 1967
* Special Orders Number 148, Headquarters, 1st Brigade, 101st Airborne Division, Vietnam, dated 27 May 1967
* Special Orders Number 178, Headquarters, 82nd Airborne Division, Fort Bragg, NC, dated 19 July 1967

3.  The above documents all show his MOS as 11B4P and are considered new evidence requiring reconsideration by the Board.

4.  The applicant served in the Regular Army (RA) from 1 March 1962 to 16 February 1965, during which time he held MOS 311.10 (Infantry Communications Specialist).

5.  On 11 May 1965, the applicant again enlisted in the RA for a 3-year period.  Based on his previous military education and as a member of the Signal Corps, he was awarded MOS 36K (Tactical Wire Operations Specialist).

6.  The applicant was assigned to Company B, 2nd Battalion (Airborne), 327th Infantry Regiment, 101st Airborne Division in the Republic of Vietnam (RVN) from approximately June 1966 to approximately May 1967 [the specific dates are not available].

7.  The orders provided by the applicant show his primary MOS was changed to 11B4P (Airborne Infantryman) during and after his tenure with Company B, 2nd Battalion (Airborne), 327th Infantry Regiment, 101st Airborne Division.

8.  Army Regulation 600-8-22 (Military Awards) states the Combat Infantryman Badge is awarded to infantry officers and to enlisted and warrant officer persons who have an infantry military occupational specialty (MOS).  They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental or smaller size.  Additionally, Appendix V of U.S. Army Vietnam (USARV) Regulation 672-1 states that during the Vietnam era the Combat Infantryman Badge was awarded only to enlisted individuals who held and served in MOS 11B, 11C, 11D, 11F, 11G, or 11H.

9.  The available evidence shows the applicant was awarded the Bronze Star Medal for meritorious achievement in ground operations against hostile forces in the RVN from 7 June 1966 to 11 April 1967.

10.  Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the awards received by units serving in Vietnam.  This pamphlet shows the 2nd Battalion, 327th Infantry, was cited for award of the Meritorious Unit Commendation for the period 29 July 1965 to 1 October 1966 by Department of the Army General Order (DAGO) Number 1, dated 1969 and amended by DAGO 17, dated 1968.  The unit was also cited for award of the RVN Gallantry Cross with Palm Unit Citation for the periods 
1-31 July 1966 and 9 December 1966 to 18 January 1967 by DAGO Number 21, dated 1969.

11.  Department of the Army Pamphlet 672-3 also shows Company B, 2nd Battalion (Airborne), 327th Infantry Regiment, 101st Airborne Division was cited for award of the Presidential Unit Citation for the period 2-20 June 1966 by DAGO Number 59, dated 1968.

12.  The applicant's records show he has a DD Form 214 for the period 27 December 1990 to 3 June 1991 when he was mobilized as a U.S. Army Reserve Soldier for Operation Desert Storm.  This DD Form 214 reflects his Bronze Star Medal; however, his DD Form 214 for his Vietnam Service does not.

DISCUSSION AND CONCLUSIONS:

1.  The applicant requests award of the Combat Infantryman Badge.

2.  The applicant's new evidence – orders and the letter from his former company commander – are accepted as proof he was assigned to an infantry company, held an infantry MOS, and participated in active ground combat.

3.  The applicant should be awarded the Combat Infantryman Badge.

4.  Additionally, the applicant's records show he is entitled to correction of his 
DD Form 214's to show the Presidential Unit Citation, Meritorious Unit Commendation, two awards of the RVN Gallantry Cross with Palm Unit Citation, and the Bronze Star Medal (on his Vietnam service DD Form 214).

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20090015430, dated 18 March 2010.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* awarding him the Combat Infantryman Badge

* adding to his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for the period 11 May 1965 to 24 April 1968:

* the Combat Infantryman Badge
* the Bronze Star Medal which he was awarded for meritorious achievement in the RVN from 7 June 1966 to 11 April 1967
* the Presidential Unit Citation
* the Meritorious Unit Commendation
* two Republic of Vietnam Gallantry Cross with Palm Unit Citations

* adding to his DD Form 214 for the period 27 December 1990 to 3 June 1991:

* the Combat infantryman Badge
* the Presidential Unit Citation
