THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests removal of awards of the Bronze Star Medal, Purple Heart, Basic Aviation Badge, and Air Assault Badge from his DD Forms 214 (Certificate of Release or Discharge from Active Duty).

2.  The applicant states he does not have published orders for the awards and desires them to be removed from his records.

3.  The applicant provides copies of his DD Forms 214.

CONSIDERATION OF EVIDENCE:

1.  The applicant was serving in the United States Army Reserve (USAR) in pay grade E-4 when he was ordered to active duty in support of Operations Enduring Freedom and Iraqi Freedom on 13 February 2003.

2.  He was promoted to pay grade E-5 on 1 June 2003.

3.  He was honorably released from active duty (REFRAD) on 19 June 2004 and the DD Form 214 issued at the time of his REFRAD shows he was awarded the Bronze Star Medal.

4.  Meanwhile, he was appointed as a USAR second lieutenant on 9 June 2004 and on 8 June 2006 he was promoted to the rank of first lieutenant.

5.  He was ordered to active duty on 5 March 2007 and served until he was honorably REFRAD on 4 September 2007.  His DD Form 214 for the period ending 4 September 2007 shows he was awarded the Bronze Star Medal, Purple Heart, Basic Aviation Badge, and Air Assault Badge.

6.  A review of the applicant's official military personnel file (OMPF) failed to reveal orders for awards of the Bronze Star Medal, Purple Heart, Basic Aviation Badge, and Air Assault Badge.

7.  Army Regulation 600-8-22 (Military Awards) provides that orders are required to be published for awards of the Bronze Star Medal, Purple Heart, Basic Aviation Badge, and Air Assault Badge.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's contentions that awards of the Bronze Star Medal, Purple Heart, Basic Aviation Badge, and Air Assault Badge should be removed from his DD Forms 214 because he does not have published orders has been noted and appear to have merit.

2.  A review of his OMPF failed to reveal orders for awards of the Bronze Star Medal, Purple Heart, Basic Aviation Badge, and Air Assault Badge.  Therefore, it appears that an administrative error resulted in the entry of those awards on his DD Form 214 at the time of his REFRAD.

3.  Accordingly, these awards should be deleted from his DD Forms 214 at this time.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* deleting the Bronze Star Medal from his DD Form 214 for the period ending 19 June 2004
* deleting the Bronze Star Medal, Purple Heart, Basic Aviation Badge, and Air Assault Badge from his DD Form 214 for the period 4 September 2007
