THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of her date of rank (DOR) to award her day-for-day credit for the time she served as an officer in the Adjutant General Corps (AGC).
2. The applicant states she submitted an Army Medical Department appointment packet with the state recruiting office to ensure she would be boarded for a Medical Service Corps (MSC) area of concentration (AOC) at or near the time of her graduation from officer candidate school. However, since her MSC appointment packet was not forwarded in a timely manner, she was commissioned in the AGC instead of MSC.
3. The applicant does not provide any additional evidence.
CONSIDERATION OF EVIDENCE:
1. The applicant's records show she applied for Federal recognition as a second lieutenant (2LT), AGC, on 8 August 2009. She was commissioned as a 2LT, Army National Guard (ARNG), AGC, on 8 August 2009.
2. She was then assigned to the 87th Troop Command as a human resources officer in the AGC.
3. A memorandum, dated 19 July 2010, states the 13-15 July 2010 Medical Corps/All Corps Selection Board for the ARNG selected the applicant for commissioning in the MSC in AOC 70B (Health Services Administrator). Accordingly, she was commissioned as a 2LT, MSC, ARNG, on 19 July 2010. Her DOR was adjusted from the date of her commission in the MSC by 5 months and 18 days due to her prior commissioned service.
4. The applicant was then assigned to the 213th Medical Company as a platoon leader, MSC.
5. In the processing of this case an advisory opinion was obtained from the National Guard Bureau (NGB). NGB recommends approval of the applicant's request. NGB states the applicant's appointment was delayed through no fault of her own. The applicant was provided a copy of the advisory opinion and concurred with NGB's recommendation.
6. Department of Defense Instruction 6000.13 (Medical Manpower and Personnel), paragraph 6.1.1.2, states service on active duty or in an active status as a commissioned officer in any of the Uniformed Services, but not in the corps or professional specialty in which being appointed, shall be awarded 1/2 day of credit for each day served in the case of individuals seeking an original appointment as a health professions officer.
DISCUSSION AND CONCLUSIONS:
1. The evidence of record shows the applicant applied for a commission in the AGC, was commissioned in the AGC on 8 August 2009, and was then assigned to the 87th Troop Command as a human resources officer in the AGC. If she believed this to be an erroneous appointment, she did not have to accept it.
2. In July 2010, she was boarded and selected for a new appointment, in the MSC. She was then commissioned in the MSC and properly given half credit for the time she served as a commissioned officer in the AGC.
3. As such, there is no error or injustice in this case.
