IN THE CASE OF:
BOARD DATE: 31 May 2011
DOCKET NUMBER: AR20100028809
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his birth date as
31 October 1948 instead of 10 October 1948.
2. He states his actual date of birth is 31 October 1948.
3. He provides a copy of his DD Form 214.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant was inducted into the Army of the United States on 20 January 1969.
3. His service record includes various documents which show his date of birth as
31 October 1948, such as his:
* DD Form 47 (Record of Induction)
* DD Form 1584 (National Agency Check Request)
* DA Form 20 (Enlisted Qualification Record)
4. He was released from active duty on 8 December 1970. Item 9 (Date of Birth) on his DD Form 214 shows his date of birth as 10 October 1948.
DISCUSSION AND CONCLUSIONS:
1. A review of the documents in the applicant's service record shows his date of birth consistently appears as 31 October 1948. However, his DD Form 214 reflects his date of birth as 10 October 1948.
2. It is apparent that a clerical error resulted in the incorrect date of birth being entered on his DD Form 214. Therefore, he is entitled to correction of his
DD Form 214 to properly show his date of birth as 31 October 1948.
BOARD VOTE:
____X___ ____X_____ ____X_____ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
________ ________ ________ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by deleting the entry "10 OCT 48" from item 9 of his DD Form 214 and adding the entry "31 OCT 48."

ARMY BOARD FOR CORRECTION OF MILITARY RECORDS
RECORD OF PROCEEDINGS
1
ARMY | BCMR | CY2015 | 20150003226
The applicant requests, in effect, correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his date of birth (DOB) as 3 February 1948 instead of 3 March 1948. Item 5 (DOB) of his DD Form 47 (Record of Induction) shows his DOB as 3 February 1948. DISCUSSION AND CONCLUSIONS: The evidence of record shows the applicant consistently listed his DOB throughout his military career as 3 February 1948.
ARMY | BCMR | CY2012 | 20120022805
The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his correct date of birth (DOB) and social security number (SSN). The evidence of record shows the applicant's DOB is 5 October 1948 and this DOB is correctly recorded his military service records. The evidence of record shows the U.S. Army was not using the SSN as identification at the time the applicant entered active duty.
ARMY | BCMR | CY2013 | 20130010994
The applicant requests correction of the date of birth (DOB) entered on his DD Form 214 (Report of Separation from Active Duty) for the period ending 7 March 1975. On 20 March 1967, he signed a DD Form 398 (Statement of Personal History) certifying the information he had provided on the form was correct. DISCUSSION AND CONCLUSIONS: The evidence shows that over the course of the applicant's military service three dates were recorded as his DOB.
ARMY | BCMR | CY2014 | 20140015498
The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his date of birth (DOB) as XX August 1948 instead of XX April 1948. DISCUSSION AND CONCLUSIONS: The applicant contends he was born on XX August 1948 and his DD Form 1584 shows his correct DOB was recorded in his record while he was serving on active duty. Therefore, the evidence of record is sufficient to correct his DD Form 214 to show his DOB as XX August 1948...
ARMY | BCMR | CY2004 | 20040006960C070208
The applicant requests, in effect, that his military records be corrected to show that his date of birth is 2 January 1943 instead of 2 January 1948. The record also shows the applicant's date of birth as 2 January 1948. Although the applicant has provided a birth certificate, he offers no explanation as to why his school records prior to his military service show the date of birth as 2 January 1948, why he did not request a correction of his military records over a 21 year Army career, or...
ARMY | BCMR | CY2011 | 20110006314
This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. His enlistment contract, dated 31 January 1968, shows he was born on 25 March 1948. Item 9 of his DD Form 214 shows he was born on 25 May 1948.
ARMY | BCMR | CY2011 | 20110024440

ARMY | BCMR | CY2008 | 20080000872
The applicant requests, in effect, correction of item 19 (Date of Entry Into Active Service), of his DD Form 214 (Report of Separation from the Armed Forces of the United States), to show the entry "27 Oct 48" (27 October 1948) instead of the entry "1 Aug 49" (1 August 1949). He has provided no evidence, and there is none in the available records, to show that his date of entry on active duty is incorrect. _ ___x____ ___ CHAIRPERSON I certify that herein is recorded the true and complete...
