THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests award of the Army Good Conduct Medal.
2. The applicant states:
* He did not receive the Army Good Conduct Medal after having fulfilled the necessary requirements for the award
* He served the necessary 3 years to receive the medal without having received any form of nonjudicial or judicial punishment
* He was awarded the Army Commendation Medal and he was put in for other awards as well
* He is currently going through the U.S. Navy Officer Candidate School which was the reason for his discharge from his enlisted status in the Army
* He is due to receive his commissioning on 3 December 2010
3. The applicant provides no documentary evidence.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Regular Army on 9 July 2007 for a period of
6 years. He completed his training and was awarded military occupational specialty 15R (AH-64 attack helicopter repairer). On 4 August 2010, he was honorably discharged in the rank/grade of specialist (SPC)/E-4 to enter the
Officer Training Program. He completed 3 years and 26 days of creditable service with no time lost.
2. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) does not show the Army Good Conduct Medal. His DD Form 214 does show, among other awards, the Army Commendation Medal as an authorized award.
3. There are no orders for the Army Good Conduct Medal in the available records.
4. There is no evidence of record that shows he was disqualified by his chain of command from receiving the first award of the Army Good Conduct Medal.
5. There is also no evidence of any disciplinary action contained in his military personnel record.
6. Army Regulation 600-8-22 (Military Awards) states the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified
DISCUSSION AND CONCLUSIONS:
The applicant was honorably discharged in the rank/grade of SPC/E-4 after completing 3 years and 26 days of creditable active service with no time lost. Since his character of service was honorable and he was discharged to enter the Officer Training Program, it appears he met the eligibility criteria for the first award of the Army Good Conduct Medal based on completion of a period of qualifying service of 3 years from 9 July 2007 through 8 July 2010 and that him not being awarded the Army Good Conduct Medal was an apparent administrative oversight. Therefore, he should be awarded the Army Good Conduct Medal (1st Award) and his DD Form 214 should be corrected to show this award.

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
a. awarding him the Army Good Conduct Medal (1st Award) for the period
9 July 2007 through 8 July 2010; and
b. adding to item 13 of his DD Form 214 the Army Good Conduct Medal
(1st Award).
