THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his overseas service was served in Korea, versus Eighth U.S. Army (EUSA).

2.  The applicant states he does not know what "EUSA" refers to on his DD Form 214, but he did serve in Korea for 13 months.

3.  The applicant provides no additional evidence.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant's records show he was inducted into the Army of the United States for a 2-year term on 1 February 1966.  He completed training and was awarded military occupational specialty 13D (Field Artillery Rocket Crewmember).

3.  Item 31 (Foreign Service) of his DA Form 20 (Enlisted Qualification Record) shows he served in Korea from 23 June 1966 through 22 July 1967.

4.  On 31 January 1968, he was honorably released from active duty and transferred to the U.S. Army Reserve Control Group to complete his remaining service obligation.  His DD Form 214 confirms he completed 2 years of total active service.  Item 22c (Foreign and/or Sea Service) shows he completed 1 year and 1 month of foreign service in the EUSA theater of operations.

5.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It establishes the standardized policy for preparing and distributing the DD Form 214.  It states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty.  It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge.  It is important that information entered on the form should be complete and accurate.  Chapter 2 of the regulation in effect at the time contained guidance on the preparation of the DD Form 214 stated that item 22c would show total active duty outside the continental limits of the United States for the period covered by the DD Form 214 and the last overseas theater in which the service was performed (e.g., EUSA, etc.).

DISCUSSION AND CONCLUSIONS:

1.  The applicant's request for correction of his DD Form 214 to show his overseas service was served in Korea versus EUSA was carefully considered; however, there is insufficient evidence to support his request.

2.  The evidence of record shows he served in the Republic of Korea; however, this duty location falls within the EUSA theater of operations.  Therefore, his DD Form 214 was correctly completed and there is no basis to grant relief in this case.
