THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his record to add the Meritorious Unit Commendation (MUC).

2.  The applicant states his unit was awarded the MUC subsequent to his discharge from the Army.

3.  The applicant provides:

* Two DD Forms 214 (Certificate of Release or Discharge from Active Duty), prepared on 30 September 2009 and on 20 December 2003
* MUC order

CONSIDERATION OF EVIDENCE:

1.  The applicant's military record shows he initially enlisted in the Regular Army on 25 June 1999 and continued to serve until he was honorably released from active duty on 20 December 2003.  His DD Form 214 shows:

   a.  item 8 (Last Duty Assignment and Major Command) - Company D, 1st Battalion, 502nd Infantry Regiment 
   
   
b. item 13 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) - does not include the MUC 
   
   c.  item 18 (Remarks) - Service in Iraq from 2 March - 10 September 2003 

2.  The applicant served two additional periods of active duty service, from 4 January 2005 to 12 July 2006 and 3 March 2007 to 30 September 2009. The MUC is not included among the list of awards shown on his 12 July 2006 or 30 September 2009 DD Forms 214.

3.  Review of the Recently Approved Unit Awards listings maintained by the Military Awards Branch of the U.S. Army Human Resources Command (USAHRC) shows 1st Battalion, 502nd Infantry Regiment, 101st Airborne Division was awarded the MUC for the period 19 March through 15 October 2003.

4.  The applicant provides Headquarters, Department of the Army, General Order Number 3 dated 6 November 2007.  It also shows 1st Battalion, 502nd Infantry Regiment, 101st Airborne Division was awarded the MUC for the period 19 March through 15 October 2003.

DISCUSSION AND CONCLUSIONS:

Based on the applicant's Iraqi service with his unit during the period in question, he is entitled to the MUC and it should be added to 20 December 2003, 12 July 2006, and 30 September 2009 DD Forms 214 at this time.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the Meritorious Unit Commendation to item 13 of his 20 December 2003, 12 July 2006, and 30 September 2009 DD Forms 214; and providing him corrections to these documents to reflect these changes.
