THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests amendment of his Army DD Form 214 (Certificate of Release or Discharge from Active Duty) to delete the Navy Achievement Medal, Marine Expert Badge (Rifle and Pistol Bars), Ranger Tab, SCUBA Divers Badge, and Parachutist Badge.  He also requests removal from his Official Military Personnel File (OMPF) the Ranger certificate of training, and orders awarding the Ranger Tab, Parachutist Badge, and SCUBA Divers Badge.

2.  The applicant states upon an administrative review of his records conducted by the Department of Homeland Security (DHS), Transportation Security Administration (TSA), he admitted to having knowledge that the awards, training and badges he has requested to be removed were incorrectly entered into his military record and DD Form 214.  

3.  The applicant provides copies of the Army DD Form 214 he wants corrected and the orders and certificates he wants removed from his records.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 8 March 1989.  

2.  The applicant completed his enlistment and was honorably discharged on 7 March 1993.  The DD Form 214 he was issued for his Army service lists Navy Achievement Medal, Marine Expert Badge (Rifle and Pistol Bars), Ranger Tab, SCUBA Divers Badge, and Parachutist Badge.

3.  The applicant's records contain the Ranger certificate of training, and orders awarding him the Ranger Tab, Parachutist Badge, and SCUBA Divers Badge.  His records also contain a DA Form 2-1 (Personnel Qualification Record) which shows the Ranger Tab.

DISCUSSION AND CONCLUSIONS:

1.  By the applicant's own admission, the entries of Navy Achievement Medal, Marine Expert Badge (Rifle and Pistol Bars), Ranger Tab, SCUBA Divers Badge, and Parachutist Badge on his Army DD Form 214 are false.  Also by his own admission, the Ranger certificate of training and orders awarding the Ranger Tab, Parachutist Badge, and SCUBA Divers Badge in his OMPF are false.  As such, it would be appropriate to amend his Army DD Form 214 to delete this award and these badges and to remove this training certificate and these orders from his OMPF.  

2.  In addition, the applicant's DA Form 2-1 should be corrected to delete the Ranger Tab.

3.  However, it is evident that these documents could affect the applicant's employment in the Federal Government and could be the subject of other investigations.  As such, it would be inappropriate to totally remove these documents from the applicant's records.

4.  As such, the removed documents will be attached to these proceedings, which will be filed in the Restricted Section of his OMPF.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  removing the entries of Navy Achievement Medal, Marine Expert Badge (Rifle and Pistol Bars), Ranger Tab, SCUBA Divers Badge, and Parachutist Badge from his Army DD Form 214; 

	b.  removing the Ranger certificate of training and orders awarding the Ranger Tab, Parachutist Badge, and SCUBA Divers Badge from the Performance Section of his OMPF, attaching them to these proceedings, and filing this record of proceedings along with the removed documents in the Restricted Portion of his OMPF; and

	c.  removing the entry Ranger Tab from his DA Form 2-1.

2.  The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to removing the records from his OMPF.
