		IN THE CASE OF:

		BOARD DATE: 9 June 2011

		DOCKET NUMBER: AR20100027221

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty), dated 7 July 2008, to show his date of entry on active duty as 30 May 2007.

2. The applicant states he served on active duty from 30 May 2007 through
7 July 2008; however, the period from 30 May to 31 July 2007 was not entered on the DD Form 214.

3. The applicant provides copies of his orders to active duty and Defense Finance and Accounting Service (DFAS) pay records.

CONSIDERATION OF EVIDENCE:

1. Orders 07-134-00004, Fort Sheridan, Illinois, dated 14 May 2007, ordered the applicant to active duty as a member of his Reserve Component unit in support of Operation Iraqi Freedom. His report date to the 948th Medical Detachment was 30 May 2007, with a subsequent report requirement of 2 June 2007 to Fort McCoy, Wisconsin. His period of active service was 400 days.

2. A review of the applicant's Retirement Points Detail Record as filed in the Interactive Personnel Records Management System shows he was on active duty for training from 30 May 2007 through 7 July 2008 (1 year, 1 month, and
8 days).

3. The DD Form 214, dated 7 July 2008, shows in Item 12a (Date Entered Active Duty This Period) 31 July 2007. Item 12c (Net Active Service This Period) shows 11 months and 7 days.

4. Army Regulation 635-5 (Separation Documents) provides detailed instructions for completing separation documents, including the DD Form 214.  It provides that the DD Form 214 is a summary of a Soldier's most recent period of continuous active service.

	a. It provides a brief, clear-cut record of active service at the time of release from active duty, retirement, or discharge.

	b. It provides that the entry in Item 12a will be the Soldier's date of entry on active duty for the current period of active duty service.

	c. The entry in Item 12c will be the actual number of years, months, and days the Soldier served on active duty during the current period of active service.

DISCUSSION AND CONCLUSIONS:

1. The applicant contends his DD Form 214, dated 7 July 2008, should be corrected to show his date of entry for this period of active service as 30 May 2007.

2. The available evidence clearly shows the applicant entered a period of active service on 30 May 2007 from which he was released on 7 July 2008, a period of 1 year, 1 month, and 8 days. Accordingly, his DD Form 214 should be corrected to show all of this active duty service.

BOARD VOTE:
