		IN THE CASE OF:

		BOARD DATE: 26 April 2011

		DOCKET NUMBER: AR20100026997

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that the dates of entry and separation on her DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show she served 3 years and 11 of months on active duty.

2. The applicant states her DD Form 214 incorrectly shows she only served
11 months of active service.

3. The applicant does not provide and additional documentation.

CONSIDERATION OF EVIDENCE:

1. The applicant's Retirement Points Detail shows that she served on active duty as a Reservist from 19 September 2005 through 18 September 2007.

2. On 27 July 2007, orders were issued directing the applicant to report for 11 months and 30 days of active duty in support of Operation Enduring Freedom in accordance with Title 10, U.S. Code, Section 12302, with a reporting date of 19 September 2007.

3. On 11 September 2008, orders were issued releasing the applicant from active duty effective 17 September 2008.

4. She was issued a DD Form 214 which shows she entered active duty on
19 September 2007 and she was separated from active duty on 17 September 2008 after completing a total of 11 months and 29 days of net active service this period.

5. Army Regulation 635–5 (Personnel Separations), states that Reserve component Soldiers completing 90 days or more of continuous active duty for training (ADT), Full-Time National Guard Duty (FTNGD), active duty for special work (ADSW), temporary tours of active duty (TTAD), or Active Guard Reserve (AGR) service; and USAR Soldiers mobilized under sections 12301(a), 12302, or 12304, Title 10, U.S. Code, regardless of length of service, are to be issued DD Forms 214.

DISCUSSION AND CONCLUSIONS:

1. The applicant served continuously on active duty from 19 September 2005 through 17 September 2008. As such, she should be issued a DD Form 214 that covers the entire period.

2. However, a portion of that active duty was in support of Operation Enduring Freedom in accordance with Title 10, U.S. Code, Section 12302. Since there are certain benefits which are provided to Soldiers mobilized under Title 10, U.S. Code, Section 12302, when a new DD Form 214 is published to incorporate the applicant's entire period of active duty, this portion of the service should be identified in Item 18 (Remarks).
