		BOARD DATE: 14 April 2011

		DOCKET NUMBER: AR20100025245

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant, the wife of a deceased former service member (FSM), requests correction of the FSM's DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show award of the Distinguished Flying Cross.

2. The applicant states she was going through the FSM's belongings and found his medals, one being the Distinguished Flying Cross, and would like his records corrected to show this award.

3. The applicant provides a copy of the FSM's DD Form 214.

CONSIDERATION OF EVIDENCE:

1. On 11 September 1968, the applicant enlisted in the Regular Army for 3 years. He completed training as a helicopter repairman. He was honorably released from active duty on 5 September 1971.

2. Item 24 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows the National Defense Service Medal, Vietnam Campaign Medal, overseas service bar (2), and Expert Marksmanship Qualification Badge with Rifle bar (M-16).

3. A review of the available record does not reveal orders awarding the applicant the Distinguished Flying Cross.

4. A review of the Awards and Decorations Computer-Assisted Retrieval System, an index of general orders issued during the Vietnam Era between 1965 and 1973 maintained by the Military Awards Branch of the U.S. Army Human Resources Command, failed to reveal orders awarding him the Distinguished Flying Cross.

5. Army Regulation 600-8-22 (Military Awards) states the Distinguished Flying Cross is awarded to any person who, while serving in any capacity with the Army, distinguishes himself or herself by heroism or extraordinary achievement while participating in aerial flight. The performance of the act of heroism must be evidenced by voluntary action above and beyond the call of duty. The extraordinary achievement must have resulted in an accomplishment so exceptional and outstanding as to clearly set the individual apart from his or her comrades or from other persons in similar circumstances. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required.

DISCUSSION AND CONCLUSIONS:

1. The applicant, the wife of a deceased FSM, requests correction of the FSM's DD Form 214 to show award of the Distinguished Flying Cross.

2. There is no evidence in the available record and no evidence was submitted showing orders were ever published awarding the FSM the Distinguished Flying Cross. Therefore, this award should not be added to his DD Form 214.

3. Regrettably, in view of the above the applicant's request should be denied.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

___x__ ____x____ ____x____ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

The applicant, the daughter of deceased former service member (FSM), requests: a. item 13 (Awards) of the FSM's DA Form 2339 (Application for Voluntary Retirement) be corrected to show an "X" in the Soldier's Medal block. Evidence shows the FSM was awarded the Soldier's Medal for heroism on 28 October 1971 and his DD Form 214 for the period ending 31 August 1986 shows this medal as an authorized award. The applicant states: a. The Army Board for Correction of Military Records (ABCMR) denied her request for a 10% increase in the FSM's retired pay for being the recipient of the Soldier's Medal. Unfortunately, the FSM's actions did not rise to the level of heroism required for award of the Distinguished Service Cross and did not clearly set him apart from those several other individuals who also risked their lives in attempting to rescue a person prior to the FSM rescuing them.

The applicant provides: * orders awarding him the Distinguished Flying Cross * his DD Form 214 CONSIDERATION OF EVIDENCE: 1. The disparity between his SSN on his DD Form 214 and his orders for the Distinguished Flying Cross is noted. Therefore, the "V" device is not authorized for the Distinguished Flying Cross because the award itself indicates it was awarded for heroism or extraordinary achievement.

Although the applicant's Army orders for the Distinguished Flying Cross for heroism on 13 June 1966 were revoked, the evidence of record shows that the Secretary of the Navy approved an award of the Distinguished Flying Cross for the applicant for heroism on 13 June 1966 in Vietnam. The Secretary of the Navy's decision, dated 1 March 1967, is accepted as sufficient evidence on which to amend his DD Form 214 for the period ending 10 May 1968 to show this award.
