THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 11 November 2009 to show his deployment to Afghanistan.

2.  He states he served in Afghanistan from 5 November 2008 until July 2009 but his DD Form 214 shows no foreign service time.

3.  He provides a copy of his DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Army National Guard and he was ordered to active duty on 21 August 2008 in support of Operation Enduring Freedom.  He was honorably released from active duty on 11 November 2009 by reason of completion of required active service.  His DD Form 214 for this period of service shows in:

* Item 12f (Foreign Service) the entry "0000  00  00," indicating no foreign service during this period
* Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) the:

* Army Commendation Medal
* U.S. Navy Achievement Medal
* 
Army Good Conduct Medal
* National Defense Service Medal
* Global War on Terrorism Service Medal
* Army Service Ribbon
* Armed Forces Reserve Medal with M Device
* Combat Infantryman Badge

* Item 18 (Remarks) the entry "//ORDERED TO ACTIVE DUTY IN SUPPORT OF OPERATION ENDURING FREEDOM IAW 10 USC 12302 [in accordance with Title 10, U.S. Code, section 12302]//"

2.  The Defense Finance and Accounting Service (DFAS) verified that his record shows he received hostile fire/imminent danger pay (HF/IDP) from 31 October 2008 through 11 November 2009 for Afghanistan.  It was also noted that the applicant was medically evacuated from Afghanistan on 9 July 2009 and he was assigned as a Wounded Warrior [at Walter Reed Army Medical Center] from
9 July 2009 through his discharge date on 11 November 2009.

3.  Army Regulation 635-5 (Personnel Separations - Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It establishes standardized policy for the preparation of the DD Form 214.  It states for:

* item 12f, enter the total amount of foreign service completed during the period covered in this report
* item 18, for a Reserve Soldier ordered to active duty and deployed to a foreign country, enter the following three statements in succession.

* “ORDERED TO ACTIVE DUTY IN SUPPORT OF (OPERATION NAME) PER 10 USC (applicable section)”
* “SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)”
* “SOLDIER COMPLETED PERIOD FOR WHICH ORDERED TO ACTIVE DUTY FOR PURPOSE OF POSTSERVICE BENEFITS AND ENTITLEMENTS”

4.  Army Regulation 600-8-22 (Military Awards) states the Afghanistan Campaign Medal is awarded to members who have served in direct support of Operation Enduring Freedom.  The area of eligibility encompasses all the land area of the country of Afghanistan and all air spaces above the land area.  The period of 

eligibility is on or after 24 October 2001 to a future date to be determined by the Secretary of Defense or the cessation of Operation Enduring Freedom.  A bronze service star is authorized for wear with this medal for participation in each credited campaign.  Approved designated Afghanistan campaigns are:

* Liberation of Afghanistan (11 September 2001 - 30 November 2001)
* Consolidation I (1 December 2001 - 30 September 2006)
* Consolidation II (1 October 2006 - date to be determined)

DISCUSSION AND CONCLUSIONS:

1.  DFAS verified the applicant served in Afghanistan from 31 October 2008 through 8 July 2009, until he was medically evacuated on 9 July 2009.  His service in Afghanistan equates to 8 months and 9 days of foreign service.  Therefore, item 12f of his DD Form 214 should be corrected accordingly.

2.  Based on his service in Afghanistan, he is entitled to the Afghanistan Campaign Medal with one bronze service star.  Therefore, his DD Form 214 should be corrected to show this award.

3.  The statement "ORDERED TO ACTIVE DUTY IN SUPPORT OF OPERATION ENDURING FREEDOM IAW 10 USC 12302" already appears in item 18 of his DD Form 214.  However, for Reserve Soldiers ordered to active duty and deployed to a foreign country, two additional statements are required.  Therefore, his DD Form 214 should be corrected to show the two additional statements as indicated below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  deleting from item 12f of his DD Form 214 for the period ending 
11 November 2009 the entry "0000  00  00" and replacing it with the entry
"0000  08  09";

	b.  adding to item 13 of his DD Form 214 for the period ending 11 November 2009 the Afghanistan Campaign Medal with one bronze service star; and

	c.  adding to item 18 of his DD Form 214 the entry "SERVICE IN AFGHANISTAN FROM 20081031 - 20090708" and "SOLDIER COMPLETED PERIOD FOR WHICH ORDERED TO ACTIVE DUTY FOR PURPOSE OF POST-SERVICE BENEFITS AND ENTITLEMENTS."
