THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his service in Iraq and Afghanistan.  He also requests correction of his DD Form 214 to show the following awards:

* Combat Infantryman Badge
* two Army Commendation Medals
* Army Achievement Medal

2.  The applicant states facts were omitted at the time his DD Form 214 was being completed.

3.  The applicant provides:

* DD Form 214, dated 23 July 2008
* Headquarters, Coalition Task Force 82, Permanent Orders 091-1091
* Headquarters, 2nd Battalion, 505th Parachute Infantry Regiment, Permanent Order Number 291-36
* Headquarters, 1st Brigade, 82nd Airborne Division, Permanent Order Number 074-374
* Headquarters, 1st Brigade, 82nd Airborne Division, Permanent Order Number 136-201


CONSIDERATION OF EVIDENCE:

1.  On 24 January 2002, the applicant enlisted in the Regular Army for 6 years.  He completed training as an infantryman.  He extended his period of enlistment for 6 months on 5 January 2006.

2.  The applicant was honorably released from active duty on 23 July 2008 at the completion of his required active service.

3.  The DD Form 214 he received shows that following awards:

* Army Good Conduct Medal
* National Defense Service Medal
* Global War on Terrorism Service Medal
* U.S. Army Recruiter Badge (Gold) with one sapphire achievement star

4.  There is no foreign service shown in item 12f (Foreign Service) or in item 18 (Remarks) of the applicant's DD Form 214.

5.  His DA Form 2-1 (Personnel Qualification Record) shows he qualified for the Marksman Marksmanship Qualification Badge with Rifle and Grenade Bars.

6.  The applicant submits the following:

* Headquarters, Coalition Task Force 82, Permanent Orders 091-1091, awarding him the Combat Infantryman Badge for the period 21 January 2003 through 31 April 2003
* Headquarters, 2nd Battalion 505th Parachute Infantry Regiment, Permanent Order Number 291-36, awarding him the Army Achievement Medal for the period 3 September 2005 through 27 September 2005
* Headquarters, 1st Brigade, 82nd Airborne Division Permanent, Order Number 074-374, awarding him the Army Commendation Medal for the period 15 January 2004 through 15 May 2004
* Headquarters, 1st Brigade, 82nd Airborne Division Permanent Order Number 136-201, awarding him the Army Commendation Medal for the period 6 February 2003 through 1 July 2003

7.  Information obtained from the Defense Finance and Accounting Service shows the applicant received imminent danger pay (IDP) for service in Afghanistan from 8 January 2003 through 17 August 2003.  He also received IDP for service in Iraq from 18 January 2004 through 19 April 2004.

8.  Army Regulation 600-8-22 (Military Awards) states the Iraq Campaign Medal is awarded to members who served in direct support of Operation Iraqi Freedom (OIF).  The area of eligibility (AOE) encompasses all the land area of the country of Iraq, the contiguous water area out to 12 nautical miles, and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles.  The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 to a future date to be determined by the Secretary of Defense or the cessation of OIF.   A bronze service star is authorized for wear with this medal for participation in each credited campaign.  Approved campaigns are:

* Liberation of Iraq (19 March 2003-1 May 2003)
* Transition of Iraq (2 May 2003-28 June 2004)
* Iraqi Governance (29 June 2004-15 December 2005)
* National Resolution (16 December 2005-9 January 2007)
* Iraqi Surge (10 January 2007-31 December 2008)
* Iraqi Sovereignty (1 January 2009-date to be determined)

9.  Army Regulation 600-8-22 (Military Awards) states the Afghanistan Campaign Medal is awarded to members who have served in direct support of Operation Enduring Freedom (OEF).  The area of eligibility encompasses all the land area of the country of Afghanistan and all air spaces above the land area.  The period of eligibility is on or after 24 October 2001 to a future date to be determined by the Secretary of Defense or the cessation of OEF.  A bronze service star is authorized for wear with this medal for participation in each credited campaign.  Approved designated Afghanistan campaigns are:

* Liberation of Afghanistan (11 September 2001-30 November 2001)
* Consolidation I (1 December 2001-30 September 2006)
* Consolidation II (1 October 2006-date to be determined

10.  Army Regulation 635-5 (Separation Documents) serves as the authority for the preparation of the DD Form 214.  It provides that the DD Form 214 will be prepared to reflect an individual's service, as it exists on the date of REFRAD or discharge.  It states:

	a.  from the Enlisted Record Brief/Officer Record Brief, enter the total amount of foreign service completed during the period covered by the DD Form 214 in item 12f;

	b.  in item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized), enter all awards, decorations, medals, badges, citations, and campaign ribbons awarded or authorized for all periods of service; and

	c.  for an active duty Soldier deployed with his or her unit during their continuous period of active service, the statement "SERVICE IN (NAME OF COUNTRY DEPOLYED) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)" will be entered in item 18.  Only deployment in an imminent danger/hostile fire zone will be reflected.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's contentions have been noted.  His supporting documents have been considered.

2.  He is authorized the following awards which should be shown on his DD Form 214:

* Army Commendation Medal (2nd Award)
* Army Achievement Medal
* Combat Infantryman Badge
* Iraq Campaign Medal with one bronze service star
* Afghanistan Campaign Medal with two bronze service stars
* Marksman Marksmanship Qualification Badge with Rifle and Grenade Bars

3.  His DD Form 214 should be corrected to show he served in Afghanistan from 8 January 2003 through 17 August 2003 and in Iraq from 18 January 2004 through 19 April 2004.  His DD Form 214 should also be corrected to show 10 months and 12 days of foreign service.

BOARD DETERMINATION/RECOMMENDATION:
