		IN THE CASE OF:

		BOARD DATE: 3 February 2011

		DOCKET NUMBER: AR20100020227

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that his narrative reason for separation be corrected to read "release from active duty."

2. The applicant states, in effect, that he was called to active duty for service in Iraq, not for training.

3. The applicant provides a copy of his separation orders.

CONSIDERATION OF EVIDENCE:

1. On 21 November 2003, the applicant accepted a U.S. Army Reserve commission as a second lieutenant.

2. Effective 7 April 2007, the applicant transferred to the Colorado Army National Guard in the rank of captain with a transfer to the Rhode Island Army National Guard effective 12 October 2010.

3. The applicant was mobilized in support of Operation Iraqi Freedom on 3 December 2009 and served in Iraq from 6 January 2010 through 27 March 2010 with release from active duty on 16 April 2010.

4. His DD Form 214 (Certificate of Release or Discharge from Active Duty) shows his period of active duty as noted above. Item 23 (Type of Release) is recorded as "release from active duty training" and a narrative reason for separation of "completion of required active service."

5. Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214. Care must be taken to ensure all entries are correct.

DISCUSSION AND CONCLUSIONS:

1. The applicant was mobilized in support of Operation Iraqi Freedom and is shown to have served in Iraq from 6 January 2010 through 27 March 2010.

2. This period of service was not training and, as such, the entry in item 23 of his DD Form 214 is in error and should be corrected to read "released from active duty."

BOARD VOTE:

___X____ __X____ ____X___ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing "released from active duty" in item 23 of his DD Form 214.
