THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests his foreign service and the following awards be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty):

* Army Commendation Medal (ARCOM)
* Global War on Terrorism Service Medal (GWOTSM)
* Overseas Service Ribbon (OSR)
* Iraq Campaign Medal (ICM)
* Purple Heart (PH)

2.  The applicant states:

	a.  he earned the ARCOM, GWOTSM, OSR, and ICM;

	b.  his foreign service is not reflected on his DD Form 214; and

	c.  he wants to apply for the PH.

3.  The applicant provides the following:

* DD Form 214
* Memorandum, dated 22 February 2007
* Certificate of Achievement
* ARCOM Certificate
* Standard Form 600 (Chronological Record of Medical Care)

CONSIDERATION OF EVIDENCE:

1.  Army Regulation 600-8-22 contains the Army's awards policy.  Paragraph 2-8 which contains the policy regarding award of the PH states that all requests for this award will be submitted to the Commander, U.S. Army Human Resources Command (AHRC), ATTN:  AHRC-PDP-A, 1600 Spearhead Division Avenue, Department 100, Fort Knox, KY  40122-5100.  As a result, the applicant has been informed how to apply to the AHRC for the PH under a separate cover and this portion of his request will not be further discussed.

2.  The applicant's military record shows he enlisted in the Regular Army on 13 September 2005.  He was trained in and served in military occupational specialty (MOS) 11B (Infantryman).

3.  His official military personnel file contains Headquarters, Multi-National Division (Baghdad), Camp Liberty, Iraq, Permanent Orders Number 253-048, dated 10 September 2006, showing:

	a.  the applicant was assigned for duty with Company B, 1st Battalion, 22nd Infantry Division, 1st Brigade, 4th Infantry Division; and

	b.  he was awarded the Combat Infantryman Badge (CIB).

4.  On 12 July 2007, the applicant was honorably discharged from active duty after completing 1 year and 10 months of creditable active duty service.  The DD Form 214 issued at that time contains the entry "0000  00  00" in item 12f (Foreign Service).

5.  Item 13 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows the applicant earned the following awards during his tenure on active duty:

* National Defense Service Medal
* Army Service Ribbon
* CIB

6.  The applicant provides AHRC memorandum, dated 22 February 2007, subject:  Meritorious Unit Commendation (MUC).  It shows the MUC was awarded to 1st Brigade, 4th Infantry Division, and its subordinate units for the period 5 December 2005 to 2 December 2006.

7.  The applicant provides an ARCOM Certificate which shows he received this award for meritorious service while serving with Company B, 1st Battalion, 22nd Infantry Regiment, in support of Operation Iraqi Freedom during the period 4 December 2005 to 2 December 2006.  It also shows this ARCOM was announced in Headquarters, 1st Brigade, 4th Infantry Division, Order Number 225-090.

8.  Army Regulation 600-8-22 (Military Awards) prescribes Army policy and criteria concerning individual military awards.

	a.  Paragraph 2-17 contains guidance on the ICM.  It states the ICM is authorized for service in Iraq from 19 March 2003 to a future date to be determined by the Secretary of Defense or the cessation of the operation.  A bronze service star is authorized with this award for each Iraq campaign a member is credited with participating in.  During the applicant's tenure of assignment, participation credit was granted for the Iraqi Governance (29 June 2004-15 December 2005) and National Resolution (16 December 2005-9 January 2007) campaigns.

	b.  Paragraph 2-19 contains guidance on award of the GWOTSM.  It states the GWOTSM is authorized to members who participated in the Global War on Terrorism operations outside of the designated area of eligibility for the Global War on Terrorism Expeditionary Medal on or after 11 September 2001 to a future date to be determined.  All Soldiers on active duty, including Reserve Component Soldiers mobilized or National Guard Soldiers activated, during the qualifying period having served 30 consecutive or 60 nonconsecutive days are authorized the GWOTSM.

	c.  Paragraph 5-4 provides guidance on the award of the OSR.  It states the OSR is authorized for completion of normal overseas tours as defined in Army Regulation 614-30 (Overseas Service).  Table 3-2 of Army Regulation 614-30 identifies tour completion criteria and states that in order to receive tour credit for temporary change of station/temporary duty service in isolated areas where tour lengths have not been established (Iraq/Afghanistan), a member must complete 11 cumulative months in a 24-month period or 9 continuous months.

9.  The AHRC Military Awards Branch listing of recently approved unit awards confirms the MUC was awarded to 1st Brigade, 4th Infantry Division, for the period 5 December 2005 to 2 December 2006.  However, the general orders are still pending.

10.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents that are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army.  It establishes standardized policy for preparing and distributing the DD Form 214.  Paragraph 2-4h states to enter the total amount of foreign service completed during the period covered by the DD Form 214 in item 12f and further specifies that for active duty Soldiers deployed with their unit, the entry "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)" will be entered in item 18 (Remarks).

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends his DD Form 214 should be corrected to show the ARCOM, GWOTSM, OSR, ICM, and his foreign service.

2.  The evidence of record confirms the applicant completed 11 months and 28 days of service in Iraq with 1st Battalion, 22nd Infantry Regiment, 1st Brigade, 4th Infantry Division, from 4 December 2005 to 2 December 2006 as evidenced in the ARCOM Certificate he provides.  This certificate also confirms his ARCOM was announced in official orders.  Based on the applicant's service in Iraq and his service on active duty for more than 30 consecutive days after 11 September 2001, his DD Form 214 should be corrected by:

	a.  showing the entry "0000  11  28" in item 12f;

	b.  adding the ARCOM, ICM with two bronze service stars, GWOTSM, OSR, and MUC to item 13; and

	c.  adding the entry "SERVICE IN IRAQ FROM 20051204-20061202" to item 18.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 as follows:
	a.  item 12f – delete the current entry and replace it with the entry "0000  11  28";

	b.  item 13 – add the ARCOM, ICM with two bronze service stars, GWOTSM, OSR, and MUC;

	c.  item 18 – add the entry "SERVICE IN IRAQ FROM 20051204-20061202"; and

	d.  issuing a correction to his DD Form 214 to reflect these changes.
