THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his request for correction of his record to show award of the Korea Defense Service Medal (KDSM).

2.  The applicant states he completed two tours in the Republic of Korea.

3.  The applicant provides copies of an Enlisted Record Brief (ERB), dated 26 November 2002, and a DA Form 2-1 (Personnel Qualification Record).

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20090017750 on 25 May 2010.

2.  The applicant provides new evidence that requires consideration by the Board.

3.  The ERB provided by the applicant shows he served in Korea from 9 May 1983 to 4 May 1984 and again from 27 April 1993 to 15 April 1994.  These dates of service in Korea are also entered in item 5 (Oversea Service) of his DA Form 2-1.

4.  His DD Form 214 (Certificate of Release or Discharge from Active Duty), as amended by a DD Form 215 (Correction to DD Form 214) dated 20 July 2010, does not show award of the KDSM in item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized).

5.  Army Regulation 600-8-22 (Military Awards) states the KDSM is authorized for award to members of the Armed Forces of the United States who have served on active duty in support of the defense of the Republic of Korea.  The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense.

6.  Army Regulation 635-5 (Separation Documents) establishes standardized policy for preparing the DD Form 214.  Instructions for completion of item 13 state to list all awards earned during military service.

DISCUSSION AND CONCLUSIONS:

The documents provided by the applicant confirm he served on active duty in Korea during the period of eligibility for award of the KDSM.  Therefore, he is entitled to correction of his record to show the KDSM.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20090017750, dated 25 May 2010.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the KDSM to his DD Form 214.
