THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his earlier request for correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the Combat Infantryman Badge.

2.  He states he has orders that show he was awarded the Combat Infantryman Badge.

3.  The applicant provides special orders.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20090017110 on 6 May 2010.

2.  His orders are new evidence which requires consideration by the Board.

3.  The applicant was inducted into the Army of the United States on 28 October 1966 and successfully completed basic and advanced individual training. He was awarded military occupational specialty 11D (Armor Intelligence Specialist).

4.  He served in Vietnam from 1 July 1967 to on or about 28 June 1968.  He was assigned to Troop A, 3rd Squadron, 4th Cavalry, 25th Infantry.

5.  Special Orders Number 188, dated 6 July 1968, issued by Headquarters, 25th Infantry Division, awarded him the Combat Infantryman Badge.

6.  On 25 October 1968, he was honorably released from active duty in the rank of specialist four (SP4)/E-4 after completing 1 year, 11 months, and 28 days of creditable active service.

7.  Item 24 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Authorized or Awarded) of his DD Form 214 for the period ending 25 October 1968 shows he was awarded:

* National Defense Service Medal
* Vietnam Service Medal with three bronze service stars
* Republic of Vietnam Campaign Medal with Device (1960)
* Army Commendation Medal
* Purple Heart
* Expert Marksmanship Qualification Badge (Rifle)

8.  There is no evidence the applicant received the first award of the Army Good Conduct Medal.  His records do not contain any adverse information and his DA Form 20 (Enlisted Qualification Record) shows his conduct and efficiency ratings as "excellent" throughout his period of service.

9.  Army Regulation 672-5-1 (Military Awards), in effect at the time, provided policy and criteria concerning individual military decorations.  It stated the Army Good Conduct Medal was awarded for each 3 years of continuous enlisted active Federal military service completed on or after 27 August 1940 and, for the first award only, upon termination of service on or after 27 June 1950 of less than 3 years but more than 1 year.  At the time, a Soldier's conduct and efficiency ratings must have been rated as "excellent" for the entire period of qualifying service.

10.  Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the awards received by units serving in Vietnam.  This pamphlet shows that at the time of the applicant's assignment to the 3rd Squadron, 4th Cavalry, it was cited for award of the:

* Presidential Unit Citation on 31 January 1968 based on Department of the Army General Orders (DAGO) Number 69, dated 1969
* Republic of Vietnam Gallantry Cross with Palm Unit Citation for the period August 1966 through August 1968 by DAGO Number 6, dated 1974
* Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation for the period 15 March 1966 through 21 January 1970 by DAGO Number 51, dated 1971

DISCUSSION AND CONCLUSIONS:

1.  The evidence of record shows the applicant was awarded the Combat Infantryman Badge.  Therefore, his DD Form 214 for the period ending 25 October 1968 should be amended to add the Combat Infantryman Badge.

2.  He was released from active duty in the rank of SP4 with 1 year, 11 months, and 28 days of creditable active service with no time lost and conduct and efficiency ratings of "excellent" throughout his period of service.  Therefore, it appears he met the eligibility criteria for award of the Army Good Conduct Medal (1st Award) for the period 28 October 1966 through 25 October 1968.  He should be awarded the Army Good Conduct Medal at this time and it should be added to his DD Form 214.

3.  He was assigned to a unit during a period of time this unit was awarded the Presidential Unit Citation, the Republic of Vietnam Gallantry Cross with Palm Unit Citation, and the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation.  His DD Form 214 should be amended to add these awards.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant amendment of the ABCMR's decision in Docket Number AR20090017110, dated 6 May 2010.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:



	a.  awarding the applicant the Army Good Conduct Medal (1st Award) for the period 28 October 1966 through 25 October 1968 and

	b.  amending item 24 of his DD Form 214 to add the:

* Army Good Conduct Medal (1st Award)
* Combat Infantryman Badge
* Presidential Unit Citation
* Republic of Vietnam Gallantry Cross with Palm Unit Citation
* Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation
