THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Purple Heart, Bronze Star Medal, Navy Unit Commendation, and his completion of the Warrior Leader Course.

2.  The applicant states he left the service before these awards and training were entered on his DD Form 214.

3.  The applicant provides copies of:

* a U.S. Army Human Resources Command (HRC), Alexandria, VA, memorandum, subject:  Army Concurrence for the 1st Marine Expeditionary Force Navy Unit Commendation, dated 5 March 2010
* Permanent Orders 033-14, issued by HRC, Alexandria, dated 2 February 2010, awarding him the Purple Heart
* Permanent Orders 349-27, issued by HRC, Alexandria, dated
15 December 2009, awarding him the Bronze Star Medal (first oak leaf cluster)
* a DD Form 215 (Correction to DD Form 214), dated 28 January 2010, adding the Bronze Star Medal with one oak leaf cluster to his DD Form 214 for the period ending 27 June 2008
* a DD Form 215, 18 February 2010, adding the Purple Heart to his
DD Form 214 for the period ending 27 June 2008


* a DA Form 1059 (Service School Academic Evaluation Report), dated
21 July 2006, showing completion of the WLC
* a certificate showing the applicant completed the WLC in July 2006

CONSIDERATION OF EVIDENCE:

1.  The applicant requested that the Purple Heart and the Bronze Star Medal with one oak leaf cluster be added to his DD Form 214.  His DD Form 214 for the period ending 27 June 2008, as corrected by DD Forms 215, dated 28 January 2010 and 2 February 2010, shows he was awarded the Purple Heart and the Bronze Star Medal with one oak leaf cluster.  Therefore, this portion of the applicant's request will not be discussed further in these Proceedings.

2.  On 22 May 2006, the applicant was ordered to active duty as a member of the U.S. Army Reserve.

3.  A DA Form 1059, dated 21 July 2006, shows that the applicant successfully completed the 2-week WLC during the period 7 July 2006 through 21 July 2006.

4.  A certificate for award of the Bronze Star Medal, dated 15 December 2009, states that on 7 and 8 November 2006, the applicant, while assigned to Company B, 321st Engineer Battalion, served as a gunner in support of Operation Iraqi Freedom.  He manned the turret of his gun truck and provided suppressive fire to help shift enemy fire away from the dismounted Marines pinned down during a cache sweep operation.

5.  A memorandum from HRC, Alexandria, dated 5 March 2010, provides concurrence with the recommendation of the Commandant of the Marine Corps to award the Navy Unit Commendation to Company B, 321st Engineer Battalion for the period 13 October 2006 to 6 February 2007, for participation in operations with the 1st Marine Expeditionary Force.

6.  On 27 June 2008, the applicant was retired by reason of temporary physical disability.  He had attained the rank/grade of sergeant (SGT)/E-5.  He completed 2 years, 1 month, and 6 days of net active service this period for 2 years,
6 months, and 9 months of total active service.

7.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214, as corrected by DD Forms 215, lists his awards as the Bronze Star Medal with one oak leaf cluster, Purple Heart, Army Achievement Medal, Army Good Conduct Medal, National 


Defense Service Medal, Global War on Terrorism Service Medal, Army Service Ribbon, Overseas Service Ribbon (two awards), Armed Forces Reserve Medal with "M" Device, Combat Action Badge, Driver and Mechanic Badge with Driver - W Bar, and Iraq Campaign Medal with one bronze service star.

8.  Army Regulation 635-5 (Separation Documents) provides detailed instructions for completing separation documents, including the DD Form 214.  It provides that Item 14 (Military Education) will contain entries for completed training.

DISCUSSION AND CONCLUSIONS:

1.  The evidence shows that the applicant successfully completed the WLC.  Therefore, his DD Form 214 should be corrected to show this course.

2.  The applicant’s unit was recommended for award of the Navy Unit Commendation for actions in support of the 1st Marine Expeditionary Force.  However, there is no available evidence showing that this award recommendation was approved.  Therefore, there is insufficient evidence to add this award to his DD Form 214 at this time.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to item 14 of his DD Form 214 for the period ending 27 June 2008 the entry "Warrior Leader Course, 2 weeks, July 2006."

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends 


denial of so much of the application that pertains to award of the Navy Unit Commendation and to add this award to his DD Form 214 for the period ending 27 June 2008.
