THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests upgrade of his dishonorable discharge.

2.  The applicant states, in effect, he believes his record is unjust because the promise to go overseas was not honored by the Army.

3.  The applicant provides a four-page letter rendered by his grandson in support of this application.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.



2.  His military record is not available to the Board for review.  A fire destroyed approximately 18 million service members’ records at the National Personnel Records Center (NPRC) in 1973.  It is believed that his records were lost or destroyed in that fire.  However, there were sufficient documents on file for the Board to conduct a fair and impartial review of this case.  This case is being considered using the Form 270 (Review of the Staff Judge Advocate).

3.  The applicant submitted an AGO Form 01254 (Transcript of Military Record) which shows he enlisted in the Regular Army on 26 January 1946 and served until he was honorably discharged on 9 August 1949.

4.  The applicant's record contains a Form 270, dated 6 August 1957, which shows:

* He reenlisted in the RA on 20 February 1950 for 3 years  
* On 11 July 1957, he was convicted at a general court-martial (GCM) of desertion from 4 July 1951 through 24 May 1957
* He was sentenced to a forfeiture of all pay and allowances, confinement for 6 months, and a dishonorable discharge.

5.  The convening authority approved the sentence and after appellate review, directed the execution of the discharge.

6.  The applicant submitted an unnotarized four-page personal reference letter rendered by his grandson on 13 October 2009.  The grandson essentially provides a synopsis of his grandfather's life and asks that the members of the Board take into consideration all aspects of the applicant's life when rendering their decision because his grandfather is a good person who deserves to be buried with military honors.

7.  Court-martial convictions stand as adjudged or modified by appeal through the judicial process.  In accordance with Title 10, U.S. Code, section 1552, the authority under which this Board acts, the ABCMR is not empowered to change a discharge due to matters which should have been raised in the appellate process, rather it is only empowered to change the severity of the sentence imposed in the court-martial process and then only if clemency is determined to be appropriate.  Clemency is an act of mercy, or instance of leniency, to moderate the severity of the punishment imposed.


8.  Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel.  Paragraph 3-11 (dishonorable discharge) states that a Soldier will be given a dishonorable discharge pursuant only to an approved sentence of a GCM.  The appellate review must be completed and the affirmed sentence ordered duly executed.

9.  Army Regulation 635-200, paragraph 3-7a, provides that an honorable discharge is a separation with honor and entitles the recipient to benefits provided by law.  The honorable characterization is appropriate when the quality of the member’s service generally has met the standards of acceptable conduct and performance of duty for Army personnel or is otherwise so meritorious that any other characterization would be clearly inappropriate.

10.  Army Regulation 635-200, paragraph 3-7b, provides that a general discharge is a separation from the Army under honorable conditions.  When authorized, it is issued to a Soldier whose military record is satisfactory but not sufficiently meritorious to warrant an honorable discharge.  A characterization of under honorable conditions may be issued only when the reason for the Soldier’s separation specifically allows such characterization.

DISCUSSION AND CONCLUSIONS:

1.  The evidence of record shows the applicant was convicted by a GCM of being AWOL from 4 July 1951, during a time of war, to 24 May 1957 and he received a dishonorable discharge.  Trial by a GCM was warranted by the serious nature of the offense for which the applicant was charged and convicted.  The sentence is commensurate with the misconduct for which the applicant was convicted.

2.  Any redress by this Board of the finality of a court-martial conviction is prohibited by law.  The Board is only empowered to change a discharge if clemency is determined to be appropriate to moderate the severity of the sentence imposed.  Given the applicant's undistinguished record of service and absent any mitigating factors, the type of discharge directed and the reasons therefore were appropriate.  As a result, clemency is not warranted in this case.

3.  There is no evidence which indicates the applicant was not properly and equitably discharged in accordance with the regulations in effect at the time.  There is no evidence that all requirements of law and regulations were not met, or the rights of the applicant were not fully protected throughout the separation process.  Absent such evidence, regularity must be presumed in this case.
