THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of Block 14 (Military Education) of his
DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the:
* UH-60 Helicopter Repairer Supervisor Course (ANCOC), 12 weeks, 1991
* Primary Leadership Development Course (PLDC), 4 weeks, 1984
* Tactical Transport Helicopter Technical Inspector Course, 14 weeks, 1985
* Air Assault Course, 2 weeks, 1984
2. The applicant states these courses were omitted from his DD Form 214.
3. The applicant provides diplomas for the above courses.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant is a retired Regular Army first sergeant (1SG/E-8). He served in the Aviation Branch in helicopter maintenance.
3. The applicant's records show he completed PLDC and ANCOC. It also shows he completed the Tactical Transport Helicopter Technical Inspector Course and the Air Assault Course. His DD Form 214 does not show these courses.
4. Army Regulation 635-5 (Separation Documents) establishes the policies and procedures for the preparation and issuance of separation documents, including the DD Form 214. It states the DD Form 214 is prepared for all Soldiers at the time of their discharge, retirement, or release from the Active Army. It is not prepared when a Soldier is discharged for the purpose of immediate reenlistment. Block 14 states to list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214. Include title, length in weeks, and year completed. This information is to assist the Soldier in job placement and counseling; therefore, do not list training courses for combat skills.
DISCUSSION AND CONCLUSIONS:
1. The applicant completed the following courses and he contends that they should be added to his DD Form 214:
* UH-60 Helicopter Repairer Supervisor Course (ANCOC), 12 weeks, 1991
* Primary Leadership Development Course (PLDC), 4 weeks, 1984
* Tactical Transport Helicopter Technical Inspector Course, 14 weeks, 1985
* Air Assault Course, 2 weeks, 1984
2. The above courses should be added to Block 14 of his DD Form 214.
