		IN THE CASE OF:

		BOARD DATE: 31 August 2010

		DOCKET NUMBER: AR20100007965

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The widow of a former service member (FSM) requests correction of the FSM's DD Form 256A (Honorable Discharge) to show he was released from the service in 1952 instead of 1962.

2. The applicant states the year shown on the DD Form 256A is an error.

3. The applicant provides a copy of the FSM’s Honorable Discharge Certificate and his Death Certificate.

CONSIDERATION OF EVIDENCE:

1. The FSM's military records show he was inducted into the Army of the United States on 10 July 1956. He completed initial entry training and was awarded the military occupational specialty of personnel specialist.

2. He was honorably released from active duty on 12 April 1958 and transferred to the U.S. Army Reserve after completing 1 year, 9 months, and 12 days of active service.

3. Headquarters, U.S. Army Advisor Group (U.S. Army Reserve) Orders, dated 29 June 1962, state he was discharged from the U.S. Army Reserve (USAR) due

to expiration term of service, effective 30 June 1962. The order shows he held the rank/pay grade of specialist five/E-5 at the time of his discharge.

4. The FSM's DD Form 256A provided by the applicant shows he was discharged from the USAR on the 30th day of June 1962.

5. The FSM died on 20 November 2009.

6. Army Regulation 635-5 (Personnel Separations - Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. It states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge.

DISCUSSION AND CONCLUSIONS:

The discharge date shown on orders indicates the FSM's DD Form 256A provided by the applicant is correct as currently constituted. There is no evidence of record and the applicant provided none to show the FSM had a military status prior to July 1956. As such, there is no basis for correcting this document.

BOARD VOTE:

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case

are insufficient as a basis for correction of the records of the individual concerned.
