THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests reconsideration of the Board's denial of his request for correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to add the Army Good Conduct Medal (GCMDL).
2. The applicant states he is appealing the Board's denial of his GCMDL which was awarded to him on 28 January 1971. He points out his service time was completed without any nonjudicial punishments, disciplinary infractions, or court-martial offenses. He contends he never went absent without leave (AWOL) but was on bed-rest for the two days which were counted against him. Once he was made aware that he was counted as AWOL, he proceeded to see his first sergeant to clear up the matter. As a result, all the charges were dropped.
3. The applicant provides the following:
* A copy of General Orders (GO) Number 68, Headquarters, 2nd Armored Division, dated 28 January 1971 which awarded him the GCMDL
* Copies of correspondence from the National Personnel Records Center
* A copy of his DD Form 214
* A copy of his DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty), dated 6 November 2009
* A copy of his previous ABCMR results
CONSIDERATION OF EVIDENCE:
1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the ABCMR in Docket Number AR20090006285 on 13 August 2009.
2. The applicant's records show he enlisted in the Regular Army on 31 January 1968, for a period of 3 years. He completed basic combat and advanced individual training and was awarded military occupational specialty 11B (Light Weapons Infantryman).
3. A copy of the applicant's DD Form 214, item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized), lists the following awards: the National Defense Service Medal, the Vietnam Service Medal (VSM) with one bronze service star, the Marksman Marksmanship Qualification Badge with Machinegun Bar (M-60), and the Expert Marksmanship Qualification Badge with Rifle Bar (M-16). His DD Form 215 deletes the previously awarded VSM with one bronze service star and adds the VSM with two bronze service stars, the Republic of Vietnam Gallantry Cross with Palm Unit Citation, the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, and the Expert Marksmanship Qualification Badge with Rifle Bars (M-14) and (M-16).
4. GO Number 68 awarded the applicant the GCMDL for the period
31 January 1968 through 30 January 1971.
DISCUSSION AND CONCLUSIONS:
1. The applicant's request for reconsideration to correct his records to show award of the GCMDL was carefully considered and is supported by the evidence provided.
2. The applicant provided a copy of GO Number 68 which clearly shows he was awarded the GCMDL on 28 January 1971, for the period of service 31 January 1968 through 30 January 1971. Therefore, he is entitled to correction of his DD Form 214 to show this award.
3. In view of the foregoing, the applicants records should be corrected to add the GCMDL.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMRs decision in Docket Number AR AR20090006285, dated 13 August 2009. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to item 24 of his DD Form 214 the Army Good Conduct Medal (first award).
