		IN THE CASE OF:

		BOARD DATE: 15 July 2010

		DOCKET NUMBER: AR20100007044

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 to show the correct dates of his service in Afghanistan.

2. The applicant states the current deployment beginning date shown in item
18 (Remarks) of his DD Form 214 is incorrect because it shows he was in Afghanistan before he was issued deployment orders. He contends the beginning date of his service in Afghanistan is 28 January 2009.

3. The applicant provides a copy of his DD Form 214 in support of this application.

CONSIDERATION OF EVIDENCE:

1. The applicant's record shows that he enlisted in the Army National Guard Army on 29 August 2006 and upon completion of initial entry training was awarded military occupational specialty 42A (Human Resources Specialist).

2. Office of the Adjutant General of Virginia Orders Number 270-394, dated
26 September 2008, ordered the applicant to active duty in support of Operation Enduring Freedom.

3. A Defense Finance and Accounting Service (DFAS) pay record confirms the applicant received hostile fire pay/imminent danger pay for service in Afghanistan from 1 January 2009 through 30 November 2009.

4. Camp Shelby Joint Forces Training Center, Camp Shelby, MS, Orders Number 326-0031, dated 22 November 2009, released the applicant from active duty effective 23 December 2009. Item 18 of his DD Form 214 shows among other entries the entry "SERVICE IN AFGHANISTAN 20080128-20091223."

5. Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers upon retirement, discharge, release from active duty service, or control of the active Army. It also contains instructions for preparing the DD Form 214. This regulation provides that for item 18, show the continuous period of active service for which a Soldier was deployed. The statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates, for example, YYYYMMDD-YYYYMMDD) will be entered in item 18.

DISCUSSION AND CONCLUSIONS:

1. The applicant contends that his DD Form 214 should be corrected to reflect the correct beginning date of his service in Afghanistan.

2. The evidence in the applicant's record along with information obtained from DFAS clearly shows the applicant began his service in Afghanistan in January 2009 and not in January 2008 as shown in item 18 of his DD Form 214. Therefore, his DD Form 214 should be corrected to show the correct dates of his service in Afghanistan.

________ ________ ________ GRANT PARTIAL RELIEF

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting in item 18 of his DD Form 214 the entry "SERVICE IN AFGHANISTAN 20080128-20091223" and by adding in item 18 of his DD Form 214 the entry "SERVICE IN AFGHANISTAN 20090128-20091223."

Therefore, it would be appropriate to amend item 18 of his DD Form 214 to show his period of deployment in Afghanistan from 20030731 to 20030904.
