		IN THE CASE OF:

		BOARD DATE: 24 June 2010

		DOCKET NUMBER: AR20090019680

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that his records be corrected to show his new social security number (SSN).

2. The applicant states there was no error; he lost his social security card and it was replaced with a new number.

3. The applicant provides copies of 2009 documents from the Social Security Administration showing his old and new SSN's.

CONSIDERATION OF EVIDENCE:

1. The applicant served on active duty in the Regular Army from May 1980 to May 1983 using the older SSN.

2. Army Regulation 635-5 prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It states the DD Form 214 is a synopsis of the Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge.

DISCUSSION AND CONCLUSIONS:

1. The applicant states he lost his social security card and it was replaced with a new number.

2. There is no evidence that suggests the applicant has or would suffer any injury or injustice as a result of the Army maintaining its records with the SSN under which he served. For historical purposes, the Army has an interest in maintaining the accuracy of its records. The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created. In the absence of a showing of material error or injustice, this Board is reluctant to recommend that those records be changed.

3. While it is understandable the applicant desires to now record his current SSN in his military records, there is not a sufficiently compelling reason for compromising the integrity of the Army's records at this late date.

4. The applicant is advised that a copy of this decisional document along with the evidence he provided which shows his current SSN will be filed in his official military personnel file (OMPF). This should serve to help clarify any questions or confusion regarding the different SSN recorded in his military record and satisfy his desire to have his current SSN documented in his OMPF.

5. In view of the above, there is no basis for granting the requested relief.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

____x____ ___x_____ ___x_____ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case

are insufficient as a basis for correction of the records of the individual concerned.

The applicant's contention that his DD Form 214 should be corrected to show his SSN as "XXX-XX-X2XX" instead of "XXX-XX-X7XX" has been carefully reviewed. There is no evidence in his OMPF showing he ever served under the SSN shown on his DD Form 214 or any other SSN. ____________X_____________ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.

His records show he consistently used xxx-x7-2160 as his SSN throughout his period of military service. Based on the social security card from the Social Security Administration, his SSN is currently xxx-x1-0154; however, it is not the SSN he used when he served on active duty, and this does not change the conditions and circumstances that existed at the time his service records were created. ___________x______________ CHAIRPERSON I certify that herein is recorded the true and complete...

Application for correction of military records (with supporting documents provided, if any). The applicant states his DD Form 214 should list his SSN as "XX7-XX-XXXX" instead of "XX0-XX-XXXX." The DA Form 20 (Enlisted Qualification Record) prepared upon his entry on active duty lists his SSN as "XX7-XX-XXXX."

The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to clearly show his last name as "D----" and his Social Security Number (SSN) as "xx9-xx-xxxx" instead of "xx3-xx-xxxx." It states that the complete name and SSN of the separating service member would be entered on the DD Form 214. Therefore, it would be appropriate at this time to correct his DD Form 214 accordingly.

It appears an administrative error occurred during the preparation of his DD Form 214 that listed the first three digits of his SSN as “522.” Therefore, it would be appropriate at this time to correct his DD Form 214 to show the same SSN as listed on his Social Security card and other record documents referenced in these Proceedings. With respect to the correction of his DD Form 214 to show his middle name as “Alonso,” the evidence of record shows that upon his induction into the AUS the...

At the time of his enlistment, his SSN was recorded as "XXX-46-5356." The evidence of record shows the applicant's SSN at the time of his enlistment and discharge was "XXX-46-5356." Accordingly, there is no basis to grant the applicant's request to change the SSN recorded in his military records.

This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. However, the evidence of record clearly shows he served all of his active service under the SSN that is reflected in his available records. Therefore, since his SSN at the time is correctly reflected on his records there appears to be no...
