		BOARD DATE:	  25 May 2010

		DOCKET NUMBER:  AR20090019137

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his date of entry in the Regular Army as 11 June 1982.

2. The applicant states that his dates of service are from 11 June 1982 to
31 May 2009.

3. The applicant provides, in support of his application, a copy of his DD Form 214.

CONSIDERATION OF EVIDENCE:

1. The applicant enlisted in the Regular Army on 11 June 1982. He retired on 31 May 2009.

2. The applicant's DD Form 214 shows in:

   a.  Item 12a (Date Entered Active Duty This Period) - 1985 06 11;

   b.  Item 12b (Separation Date This Period) - 2009 05 31;

   c. Item 12c (Net Active Service This Period) - 26 years, 11 months, and
20 days;

   d. Item 12e (Total Prior Inactive Service) - 2 days; and
   e.  Item 18 (Remarks) -Immediate reenlistments this period - 19820611 – 19860227, 19860228-19880705, 19880706-19920206, 19920207-19940120, 19940121-19950606, 19950607-19961030, 19961031-20010312.

3. Orders 149-0041, Fort Stewart, Georgia, dated 28 May 2008, released the applicant from active duty effective 31 May 2009 and placed him on the retirement list effective 1 June 2009. These orders show that he had completed 26 years, 11 months, and 22 days of creditable service for basic pay.

4. Army Regulation 635-5 (Separation Documents) provides detailed instructions for completing separation documents, including the DD Form 214. It provides, in pertinent part, that the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. It provides that the entries in Item 12 (Record of Service) will show the Soldier's dates of entry, separation, and net active service for the period.

DISCUSSION AND CONCLUSIONS:

1. The applicant contends that his DD Form 214 should be corrected to show his correct dates of service in the Regular Army.

2. The applicant's retirement orders clearly show that he completed 26 years,
11 months, and 22 days of service for pay.

3. Item 18 of the applicant's DD Form 214 shows he initially enlisted in the Regular Army on 11 June 1982 and remained in an active duty status until 31 May 2009 (26 years, 11 months and 20 days). It further shows he had 2 days of prior inactive service. However, item 12a of his DD Form 214 incorrectly shows the year of his entry as 1985. This should be corrected to show 1982.
