THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant, the brother of a deceased former service member (FSM), requests correction of the FSM's DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show award of the Purple Heart.

2.  The applicant states the FSM was awarded the Purple Heart on 12 August 1967 for wounds he received in Vietnam.

3.  The applicant provides the following documents in support of his application:  a 3-page supplemental letter; his South Carolina Concealed Weapons Permit; a copy of his DD Form 214; a copy of his birth certificate; a copy of the FSM's death certificate; and a copy of a photograph of the FSM receiving the Purple Heart.

CONSIDERATION OF EVIDENCE:

1.  The FSM enlisted in the Regular Army on 15 September 1965.  He served in Vietnam from 11 April 1966 to 8 April 1967 with Company B, 7th Cavalry, 1st Cavalry Division.

2.  Item 40 (Wounds) of the FSM's DA Form 20 (Enlisted Qualification Record) shows he sustained a fragment wound to the right side of his forehead on
1 March 1967.

3.  The FSM’s name is listed on the Vietnam Casualty Roster for wounds he received in action on 1 March 1967.
4.  Headquarters, 1st Cavalry Division (Airmobile), General Orders Number 1761, dated 17 April 1967, show the FSM was awarded the Purple Heart for wounds received in action on 1 March 1967.

5.  The FSM was released from active duty on 25 October 1968.  Item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 does not show award of the Purple Heart.

6.  Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) shows that, at the time of the FSM’s assignment to Company B, 1st Battalion, 7th Cavalry, this unit was cited for award of the Presidential Unit Citation for the period 12 December 1966 to 18 February 1967 by Department of the Army General Orders Number 2, dated 1973.

7.  On 18 February 2009, a DD Form 215 (Correction to DD Form 214) added the Marksman Qualification Badge with Rifle Bar, Expert Marksmanship Qualification Badge with Machinegun Bar, Vietnam Service Medal with two bronze service stars, Republic of Vietnam Gallantry Cross with Palm Unit Citation, and the Republic of Vietnam Campaign Medal with Device (1960) to the FSM's DD Form 214.  

DISCUSSION AND CONCLUSIONS:

1.  General orders show the FSM was awarded the Purple Heart for wounds he received in action on 1 March 1967.  Therefore, the Purple Heart should be added to his DD Form 214.  

2.  The FSM was assigned to a unit during a period of time that unit was cited for award of the Presidential Unit Citation.  Therefore, this award should be added to his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to item 24 of the FSM's DD Form 214 the Purple Heart and the Presidential Unit Citation.
