		IN THE CASE OF:

		BOARD DATE: 22 April 2010

		DOCKET NUMBER: AR20090015817

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his deployment to Kuwait/Iraq.

2. The applicant states that his deployment for 7 months from June 2008 to January 2009 is not recorded on his DD Form 214.

3. The applicant provides a copy of his unit's temporary change of station orders, dated 16 April 2008.

CONSIDERATION OF EVIDENCE:

1. On 27 August 2007, the applicant enlisted in the Regular Army. He completed his initial training and was awarded military occupational specialty 92A (Automated Logistical Specialist). He was subsequently assigned to the 4th Brigade Combat Team located at Fort Hood, Texas.

2. Orders Number 107-01, Headquarters, 1st Cavalry Division, dated 16 April 2008, deployed the applicant's unit in support of Operation Iraqi Freedom with an effective date of on or about 7 June 2008. The applicant's name is included on the attached personnel roster.

3. Records show the applicant was assigned to Company A, 27th Brigade Support Battalion, 4th Brigade Combat Team, located at Camp Adder, Iraq.

4. Defense Finance and Accounting Service Records show the applicant received imminent danger pay during the period 10 June 2008 through 26 January 2009 (7 months and 17 days) for service in Kuwait.

5. On or about 26 January 2009, the applicant returned to Fort Hood, Texas, and was discharged from active duty.

6. Item 12f (Foreign Service) of his DD Form 214 shows no overseas service. Item 18 (Remarks) of this same form does not show his deployment in support of Operation Iraqi Freedom.

7. Army Regulation 635-5 (Separation Documents) provides detailed instructions for completing separation documents, including the DD Form 214. It provides, in pertinent part, for an entry in item 12f of the total amount of foreign service completed during the current period of active duty. It further provides that item 18 will contain the following entry for Regular Army Soldiers: "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)."

DISCUSSION AND CONCLUSIONS:

1. The applicant requests correction of his DD Form 214 to show his deployment to Kuwait/Iraq.

2. The available evidence shows the applicant was deployed to the Kuwait/Iraq theater of operations from 10 June 2008 through 26 January 2009. Accordingly, his DD Form 214 should be corrected to show this period of deployment.

Since the Army Achievement Medal is shown on the applicant's DD Form 214, this portion of his request will not be discussed further in these proceedings. Although the applicant requests his DD Form 214 be corrected to show more than one award of the Army Commendation Medal, orders show he received one award of the Army Commendation Medal. Therefore, his DD Form 214 will be corrected to show one award of the Army Commendation Medal.
