THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that the DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) of her spouse, a deceased former service member (FSM), be corrected.

2.  The applicant states that the FSM's DD Form 214 reflects his incorrect Social Security Number (SSN).

3.  The applicant provides a letter from the Jefferson County Department of Veterans' Affairs (VA) dated 10 July 2009, forwarding her application and additional documents to this agency; a copy of the FSM's Social Security Card; copy of the FSM's DD Form 214; a copy of the FSM's Certificate of Live Birth; a copy of her Certification of Birth; a copy of her Marriage Certificate; and a copy of the FSM's Certificate of Death.

CONSIDERATION OF EVIDENCE:

1.  On 4 January 1967, the FSM was inducted into the Army in Columbus, Ohio.  His Record of Induction shows that he was furnished a service number at the time of his induction.

2.  The FSM's records show that he continued to serve in the Army using his service number until 16 January 1968 when Special Orders Number 34 were published awarding him the Marksman Marksmanship Qualification Badge with 


Rifle Bar.  In Special Orders Number 34, the fifth digit of his SSN is reflected as 4 and the same is reflected on every document in his official military record except for his DD Form 214.

3.  The FSM was honorably released from active duty (REFRAD) on 23 December 1968 under the provisions of Army Regulation 635-200, chapter 5, as an overseas returnee.  The DD Form 214 that he was furnished shows the fifth digit of his SSN as 9 instead of 4.

4.  Army Regulation 635-5 (Separation Documents) serves as the authority for the preparation of the DD Form 214.  It provides, in pertinent part, that the DD Form 214 will be prepared to reflect an individual's service as it exists on the date of REFRAD or discharge.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that the SSN reflected on the FSM's DD Form 214 should be corrected.

2.  Her contentions have been noted and have been found to contain merit.  Every document contained in the FSM's official military record that reflects his SSN shows the fifth digit as 4.  Therefore, his DD Form 214 should be amended to reflect his correct SSN.

3.  In view of the foregoing, it would now be in the interest of justice to correct the FSM's records as recommended below.
