THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


CONSIDERATION OF ADDITIONAL EVIDENCE:

9.  On 30 July 2009 new information was received from the Defense Finance and Accounting Service (DFAS) in regard to the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20090000361, dated 25 June 2009.

10.  The evidence submitted consists of a telephonic inquiry from officials at the DFAS requesting to know if the Board intended the applicant to be paid as a result of the change to her date of rank (DOR) for promotion to the rank of colonel (COL) because the effective date was not changed, which is required in order to effect her pay entitlement to back pay and allowances.

ADDITIONAL DISCUSSION AND CONCLUSIONS:

3.  At the time of the decision of the ABCMR in Docket Number AR20090000361, dated 25 June 2009, it was the intent of the ABCMR to make the applicantÂ’s record as administratively correct as it should properly have been at the time, which included her entitlement to back pay and allowances.

4.  The ABCMR's decision in Docket Number AR20090000361 directed that the applicant's DOR for promotion to the rank of COL be adjusted to 1 June 2007 and that she be paid all back pay and allowances.  However, the Board failed to direct that the effective date of her promotion be changed, which is the date tied to pay and allowances. 

5.  Accordingly, the Board's Determination/Recommendation should be changed to direct that the applicant's DOR and effective date of promotion to the rank of COL be changed to 1 June 2007, with entitlement to all pay and allowances that flow from that change.

The Board determined that the evidence presented was sufficient to warrant amendment of the decision of the Army Board for Correction of Military Records set forth in Docket Number AR20090000361, dated 25 June 2009, to show that the applicant's DOR and effective date of promotion to the rank of COL be changed to 1 June 2007, with entitlement to all pay and allowances that flow from that change.
