THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


CONSIDERATION OF ADDITIONAL EVIDENCE:

12.  On 19 March 2009, new information was received from the applicant, in regard to the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20090000358, dated 5 March 2009.

13.  The evidence submitted consists of a copy of the applicant’s DD Form 214, dated 25 August 1984; a copy of a U.S. Marine Corps letter, dated 20 August 1987; and an undated self-authored statement. 

14.  The applicant states that paragraph 1, Consideration of Evidence, of the original ABCMR Record of Proceedings incorrectly show the date he enlisted in the U.S. Marine Corps Reserve (USMCR) as "30 May 1984."  The correct date should be "25 April 1984."  He also states that "30 May 1984" is the effective date of his pay grade to E-2 as indicated on his DD Form 214 (Certificate of Release from Active Duty), dated 25 August 1984.

15.  Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214.  The regulation directs, in pertinent part, that the purpose of the separation document is to provide the individual with documentary evidence of their military service.  It is important that information entered on the form should be complete and accurate.  Chapter 2 of Army Regulation 635-5 contains guidance on the preparation of the DD Form 214.  It states, in pertinent part, that item 12e is obtained from previously issued DD Forms 214 and/or the Soldier's records.  Item 12e shows the total amount of prior inactive service, less lost time, if any.  Delayed Entry Program (DEP) time that began on or after 1 Jan 85 is not creditable service for pay purposes and will not be entered in this block.  

ADDITIONAL DISCUSSION AND CONCLUSIONS:

5.  At the time of the ABCMR’s decision in Docket Number AR20090000358, dated 5 March 2009, it was the intent of the ABCMR to make the applicant’s record as administratively correct as it should properly have been at the time.

6.  The ABCMR's decision in Docket Number AR20090000358, incorrectly listed the date the applicant enlisted in the USMCR as "30 May 1984." 

7.  The applicant's USMC DD Form 214, dated 25 August 1984, shows the applicant entered active duty for training (ADT) on 30 May 1984 and completed the Basic Field Artillery Battery Man training course.  He was honorably released from ADT to the control of his USMCR unit on 25 August 1984.  This form shows he completed 2 months and 25 days of creditable active service.  This form also shows he completed 1 month and 5 days of prior inactive service.  This indicates that he enlisted in the USMCR under the DEP on 25 April 1984. 

8.  Therefore, the applicant is entitled to correction of the ABCMR’s Record of Proceedings, dated 5 March 2009 to show he enlisted in the USMCR on 25 April 1984.

2.  All documents issued as a result of the decision set forth in ABCMB Docket Number AR2009000358, dated 5 March 2009, should be corrected as stated.
