THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


CONSIDERATION OF ADDITIONAL EVIDENCE:

8.  On 15 July 2009, information was received from the Army Review Board Agency officials in St. Louis in regard to the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20080015551, dated 9 April 2009, indicating that there was an error made in the recommendation of the Record of Proceedings.

9.  The evidence submitted consists of a review of the Record of Proceedings in which the applicant requested that his DD Form 214 (Certificate of Release or Discharge from Active Duty) and NGB Form 22 (Report of Separation and Record of Service) be corrected to reflect his date of birth (DOB) as being 11 March 1953.  However, the Record of Proceedings directed that his DD Form 214 be corrected to show his DOB as 11 March 1953 and his NGB Form 22 be corrected to show his DOB as 10 April 1953.

ADDITIONAL DISCUSSION AND CONCLUSIONS:

3.  At the time of the decision of the ABCMR in Docket Number AR20080015551, dated 9 April 2009, it was the intent of the ABCMR to make the applicant’s record as administratively correct as it should properly have been at the time.

4.  The ABCMR's decision in Docket Number AR20080015551 incorrectly directed that the applicant's DOB on his NGB Form 22 dated 6 July 2000 be changed to reflect his DOB as being 10 April 1953, when in fact it intended the document to reflect a DOB of 11 March 1953.

5.  Accordingly, the applicant's DOB on his NGB Form 22 should be corrected to reflect the same DOB as was directed to be entered on his DD Form 214, which is 11 March 1953.

The Board determined that the evidence presented was sufficient to warrant amendment of the decision of the ABCMR set forth in Docket Number AR20080015551, dated 9 April 2009, to show that the NGB Form 22 for the period ending 6 July 2000 is corrected to show a DOB of 11 March 1953 in block 7 of that form.
