THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his records to show he was issued the Combat Action Badge.
2. The applicant states he believes he should have been awarded the Combat Action Badge for the combat action he participated in while in Vietnam.
3. The applicant provides a copy of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) in support of this application.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant's military records show he was inducted into the Army of the United States on 21 May 1968. He was awarded the military occupational specialty of weapons support radar repairer, and was promoted to pay grade E-5.
3. The applicant was released from active duty on 15 April 1970 and transferred to the US Army Reserve Control Group (Annual Training) after completing 1 year, 10 months, and 25 days of creditable active service.
4. On 2 May 2005, the Chief of Staff of the Army approved creation of the Combat Action Badge to provide special recognition to Soldiers who personally engage in or are engaged by the enemy. The Combat Action Badge may be awarded by any commander delegated authority by the Secretary of the Army during wartime or the Commanding General, US Army Human Resources Command and will be announced in permanent orders.
5. Army Regulation 600-8-22 also states that award of the Combat Action Badge is authorized from 18 September 2001 to a date to be determined. Award for qualifying service in any previous conflict is not authorized. Retroactive awards of the Combat Action Badge are not authorized prior to 18 September 2001.
DISCUSSION AND CONCLUSIONS:
The Combat Action Badge was not authorized for award during the applicant's period of service. Therefore, he is not entitled to award of this badge.

Army Regulation 600-8-22 also states that award of the Combat Action Badge is authorized from 18 September 2001 to a date to be determined. Accordingly, the applicant is not entitled to award of the CAB for his service in Vietnam.

The applicant requests award of the Combat Infantryman Badge or the Combat Action Badge. Furthermore, there are no orders in the applicant's records that show he was awarded the Combat Infantryman Badge. Additionally, Appendix V of USARV [U.S. Army, Vietnam] Regulation 672-1 provides that during the Vietnam era the Combat Infantryman Badge was awarded only to enlisted individuals who held and served in MOS 11B, 11C, 11D, 11F, 11G, or 11H.

The applicant's records do not contain orders that show he was awarded the Combat Infantryman Badge or the Combat Action Badge. The regulation further state that award of the Combat Action Badge is authorized from 18 September 2001 to a date to be determined. With respect to award of the Combat Action Badge, the evidence of record shows that the applicant served on active duty from 7 January 1953 to 6 January 1956 and from 13 March 195t to 23 May 1958.
