THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his period of active Reserve service be recorded on his DD Form 214 (Armed Forces on the United States Report of Transfer or Discharge). 

2.  The applicant states there is no record of his active Reserve service on his DD Form 214.

3.  The applicant provides his DD Form 214 and a Social Security Administration (SSA) Earnings Statement. 

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.


2.  The applicant was inducted into the Army of the United States, on
13 February 1963, completed training, and was awarded the military occupational specialty 710 (Clerk).

3.  He was promoted to specialist four on 15 July 1964 and he was honorably released from active duty on 29 December 1964 and transferred to the United States Army Reserve (USAR) Control Group (Annual Training). 

4.  The available record contains limited evidence concerning his USAR service.  He is shown to have served on active duty for training from 17 - 30 July 1966, and he completed his Ready Reserve Obligation on 28 January 1968.  He was honorably discharged from the USAR effective 31 January 1969.

5.  The SSA Earnings Statement lists the applicant's earnings but does not document what the source of those earning are.

6.  Army Regulation 635-5 prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It establishes standardized policy for the preparation of the DD Form 214.  In pertinent part, it states the DD Form 214 is a synopsis of the Soldier’s most recent period of continuous active duty.  It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that his DD Form 214 should be corrected to show his active Reserve service.

2.  The DD Form 214 was prepared to reflect the applicant’s active duty service.  It does not and would not include any reference to his USAR service especially as it occurred after he was released from active duty and the DD Form 214 had already been issued.

3.  In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust.  The applicant has failed to submit evidence that would satisfy this requirement.
