		BOARD DATE: 3 September 2009

		DOCKET NUMBER: AR20090005730

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) and his National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service) to show award of the Army Superior Unit Award.

2. The applicant states that he served with Headquarters and Headquarters Company, 1st Battalion, 635th Armor, from September 2001 to March 2007, and he deployed with this unit to Kosovo, on 7 May 2005. However, he was injured while in Kosovo and returned to the United States where he was ultimately discharged from the Kansas Army National Guard (KSARNG). He adds that he recently found out that his unit was awarded the Army Superior Unit Award for service in Kosovo and that he should have this award shown on his DD Form 214 and NGB Form 22 based on his contributions during the time he served with that unit.

3. The applicant provides a copy of his NGB Form 22, dated 31 March 2007, and a copy of his DD Form 214, dated 10 March 2006, in support of his request.

CONSIDERATION OF EVIDENCE:

1. The applicant’s records show he enlisted in the KSARNG for a period of 8 years on 18 September 1984. He was trained in and held military occupational specialty (MOS) 92F (Petroleum Supply Specialist). He also executed several extensions and/or reenlistments in the KSARNG on various dates and attained the rank/grade of sergeant (SGT)/E-5.
2. On 10 October 2004, the applicant was ordered to active duty in support of Operation Enduring Freedom and subsequently served in Kosovo from 7 February 2005 to 12 January 2006. He was honorably released from active duty to the control of his ARNG unit on 10 March 2006.

3. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows he was awarded the Driver/Mechanic Badge with Driver-Wheeled Vehicle Clasp, the German Army Marksmanship Badge (Gold), the Army Commendation Medal (2nd Award), the Army Achievement Medal (3rd Award), the Good Conduct Medal, the National Defense Service Medal, the Global War on Terrorism Service Medal, the Kosovo Campaign Medal, the Army Service Ribbon, the Overseas Service Ribbon, the Armed Forces Reserve Medal with “M” Device, and the NATO Medal.

4. On 31 March 2007, the applicant was honorably discharged from the KSARNG by reason of medical unfitness. Item 15 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded) of his NGB Form 22 shows the same awards as shown on his DD Form 214.

5. The Soldier Programs and Services Division, Awards and Decorations Branch, U.S. Army Human Resources Command website shows the 1st Battalion (less Company B), 635th Armored Regiment, was awarded the Army Superior Unit Award for its service from 1 March 2005 to 15 January 2006. The Department of the Army General Orders are pending publication.

DISCUSSION AND CONCLUSIONS:

The evidence of record shows the applicant was assigned to Headquarters and Headquarters Company, 1st Battalion, 635th Armored Regiment, during the period this unit was awarded the Army Superior Unit Award for service from 1 March 2005 to 15 January 2006. Therefore, the applicant's Department of the Army records and his ARNG records should be corrected by amending his DD Form 214 and NGB Form 22 to show this award.
