THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


CONSIDERATION OF ADDITIONAL EVIDENCE:

11.  On 16 March 2009, new information was received from the applicant in regard to the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20060010030, dated 27 February 2007.

12.  The applicant states that the original ABCMR decision stated that “it appears that he was transferred to Germany, where he served for 11 months and 4 days.” He added that he would like the Board to know that it took him some time, but he was able to obtain documentation that shows he was in France instead of Germany. 

13.  The evidence submitted consists of a DA Form 313 (U.S. Government Operator’s Permit), dated 26 May 1954; copies of the “Haan Pipe” newsletter, dated, 10 and 11 April 1953, and pictures of a U.S. Navy vessel.  The applicant requests paragraph 5 of the Record of Proceedings be corrected to show he was in France instead of Germany.

ADDITIONAL DISCUSSION AND CONCLUSIONS:

5.  At the time of the decision of the ABCMR in Docket Number AR20060010030, dated 27 February 2007, it was the intent of the ABCMR to make the applicant’s service records as administratively correct as it should properly have been at the time.

6.  The ABCMR's decision in Docket Number AR20060010030, dated 27 February 2007, erroneously showed the applicant was transferred to Germany, where he served for 11 months and 4 days in paragraph 5 of the Consideration of Evidence.  

7.  The applicant provided a newsletter that shows that his unit, the 885th Engineer Aviation Maintenance Company, was to be assigned to Toul, a small town just outside of Nancy, France.  He also provided a DD Form 313 that was issued by the 885th Engineer Aviation Maintenance Company in France.

8.  Paragraph 5, Consideration of Evidence, of the original Record of Proceedings should have showed he was transferred to France instead of Germany.

3.  The Board determined that the evidence presented was sufficient to warrant amendment of paragraph 5 of the Consideration of Evidence of the ABCMR Docket Number AR20060010030, dated 27 February 2007, to read "it appears that he was transferred to France, where he served for 11 months and 4 days."

4.  Any documents issued as a result of the decision in ABCMR, Docket Number AR20060010030, dated 27 February 2007, should be corrected, if applicable.
