		IN THE CASE OF:

		BOARD DATE: 30 July 2009

		DOCKET NUMBER: AR20090004542

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that his records be corrected to show he was awarded the Purple Heart.

2. The applicant states that he was injured when an armored personnel carrier (APC) flipped over after running over something. He was trapped under water and unconscious. He received medical treatment for his injuries.

3. The applicant provides a casualty listing for his unit which shows that the applicant was treated for klebsiella pneumonia, which was coded as "LOYAL," which denoted non-hostile serious injury or very serious injury.

CONSIDERATION OF EVIDENCE:

1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a

substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2. The applicant's military records show that he was inducted in the Army on 6 August 1969, was awarded the military occupational specialty of armor reconnaissance specialist, and was promoted to pay grade E-3. He served in Vietnam from 6 January to 28 November 1970.

3. While in Vietnam, on 17 October 1970, the applicant was hospitalized for klebsiella pneumonia. The casualty report was coded "LOYAL."

4. The applicant was honorably released from active duty at the expiration of his term of service on 6 August 1971. His DD Form 214 (Report of Separation from Active Duty) does not list the Purple Heart.

5. The applicant's DA Form 20 (Enlisted Qualification Record), Item 40, Wounds, is blank. Item 41, Awards and Decorations, does not show the Purple Heart.

6. There are no orders for the Purple Heart in the applicant's record.

7. The applicant reenlisted on 10 May 1974 and was given a general discharge for unsuitability, apathy, defective attitudes or inability to expend effort constructively, on 1 November 1976.

8. Army Regulation 600-8-22 (Military Awards) provides that the Purple Heart is awarded for wounds sustained as a result of hostile action. Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment by a medical officer, and the medical treatment must have been made a matter of official record.

DISCUSSION AND CONCLUSIONS:

1. The applicant was hospitalized for pneumonia, not for injuries. The applicant does not contend that hostile action caused his APC to turn over, and his accident report codes his injury "LOYAL," which denoted non-hostile serious injury or very serious injury.

2. Since all records show that the applicant's hospitalization was due to non-hostile causes, the available evidence indicates he does not meet the criteria for award of the Purple Heart.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

__X_____ ___X___ ___X____ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

He states that he was among the wounded. The available evidence also shows the applicant was awarded the Purple Heart for wounds received as a result of being hit by nails from a claymore on 11 April 1969. Evidence of record shows that although he received orders for a Purple Heart for wounds received on 4 August 1969 while assigned to the 12th Evacuation Hospital there is no evidence of record nor did the applicant provide any evidence which shows he was wounded on 4 August 1969.

    d. He tried to bandage his wound the best he could because they were not assigned medical personnel at the time. Army Regulation 600-8-22 (Military Awards) states the Purple Heart is awarded for a wound sustained in action against an enemy or as a result of hostile action. The applicant's DA Form 20 contains no entries indicating he was wounded in action and there is no evidence in his military records that indicates he was treated for a combat-related wound.

The applicant requests he be awarded the Purple Heart and that it be added to his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). There are no orders awarding the applicant the Purple Heart and his records do not contain evidence that he was ever wounded in action. While the Board does not question the sincerity of these statements, by themselves and without corroborating evidence, they are insufficient to establish entitlement to award of the Purple Heart.

In the original consideration of his case that occurred on 24 February 2000, the applicant submitted a medical statement indicating he had sustained an ear injury in October 1968 and in July 1999, officials from the Army's Personnel Command informed him that he was not authorized an award of the Purple Heart because his injury was considered accidental. Creditable witness statements indicate he received injuries from an enemy act (being blown off an APC due to a landmine explosion). As a...

A review of the medical records provided by the applicant show that on 4 June 1967 while conducting a combat sweep, the applicant was struck in the face by a tree limb while riding on an armored personnel carrier (APC) which required hospitalization and treatment. The applicant’s contention that he should have been awarded the Purple Heart for his injuries in Vietnam on 4 June 1967 has been noted; however, the applicant has failed to show through the evidence submitted with his application...

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual. The applicant requests correction of his records to show award of the Purple Heart for injuries he sustained in Vietnam in January 1971. The applicant’s DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) does not show the Purple Heart as an authorized award.

Headquarters, 25th Infantry Division, General Orders (GO) Number 1055, dated 8 March 1968, awarded the applicant the Purple Heart for wounds received in action against a hostile force on 5 March 1968. The applicant's request for correction of his military service records to show he sustained a concussion and was awarded a second award of the Purple Heart was carefully considered. As a result, the Board recommends that all Department of the Army records of the individual concerned be...

There is no evidence in the available records which show that the applicant was awarded the Purple Heart or was wounded as a result of hostile action in Vietnam. In the absence of orders or other evidence of record showing that the applicant was injured or treated for wounds as a result of hostile action in Vietnam, the statements provided by the applicant are not sufficient as a basis for award of the Purple Heart. Even the applicant's former first sergeant only stated that the applicant...

His DA Form 20 (Enlisted Qualification Record) shows he served in Vietnam from 15 April 1969 through sometime in August 1969 and that he was in a patient status after departing Vietnam. There is no evidence in his military records that indicates he was awarded the Purple Heart or that he was treated for a combat-related wound. In the absence of such evidence, the fact that he was in a patient status alone is insufficient evidence on which to base awarding the Purple Heart in this case.

The applicant provides: a. Although evidence clearly shows the applicant had experienced back and head trauma prior to his entry into the Army there is no evidence of record and the applicant has not provided sufficient evidence showing he sustained any injuries or that he was treated for wounds sustained as a result of hostile action while serving in the Republic of Vietnam. Absent evidence that conclusively shows the applicant sustained wounds or injuries as a result of hostile action,...
