BOARD DATE: 21 July 2009
DOCKET NUMBER: AR20090004392
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests award of the Purple Heart.
2. The applicant states that he was injured in the line of duty when he accidentally shot himself while cleaning his weapon.
3. The applicant provides, in support of his request, copies of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) and documents associated with the line of duty investigation.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the Regular Army (RA) on 6 July 1966, completed training as an infantryman and served in Vietnam from December 1966 to July 1968. His awards include the Bronze Star Medal, Air Medal, and Combat Infantryman Badge. He was honorably released from active duty and transferred to the Army Reserve (USAR) Control Group (Annual Training) to complete his remaining Reserve obligation.
3. Sworn statements from three privates first class report that the applicant shot himself in the foot while letting the hammer down on a .45 caliber pistol. The company commander reported, "I interviewed [the applicant] and those around him
my belief
was accidental." The approved line of duty investigation concluded the applicant was accidentally injured in the line of duty.
4. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Purple Heart is awarded for a wound sustained while in as a result of hostile action. Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment by medical personnel, and the medical treatment must have been made a matter of official record. This regulation also lists examples of injuries or wounds which clearly do not justify award of the Purple Heart. This listing includes "accidents, to include explosive, aircraft, vehicular, and other accidental wounding not related to or caused by enemy action."
DISCUSSION AND CONCLUSIONS:
1. The applicant states that he was injured in the line of duty when he accidentally shot himself while cleaning his weapon.
2. The governing regulation provides that the Purple Heart is awarded for a wound sustained as the result of enemy action.
3. The applicant's current assertion and the documents associated with the line of duty investigation confirm that he was accidentally injured. The record is clear; there was no enemy involvement in this incident. Therefore, there is no basis for granting the applicant's requested relief.
BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
___x____ ___x____ ____x___ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant's record includes a DA Form 2173 (Statement of Medical Examination and Duty Status) showing in item 30 (Remarks) that his unit was participating in a search and destroy mission on 21 July 1966. The investigation conducted after the incident and the statement the applicant made at the time confirm his injury was not the result of hostile action.

The applicant requests reconsideration of his earlier request to the Army Board for Correction of Military Records (ABCMR) to correct his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) by changing his military occupational specialty (MOS) from truck driver to tank gun loader, and by awarding him the Purple Heart (PH). In regards to the latter, he requests that his medical records be corrected to show he received a shrapnel wound instead of a self-inflicted...

A DA Form 2173 (Statement of Medical Examination and Duty Status), dated 1 October 1968, wherein the applicant stated that he sustained a gunshot wound to his right foot while cleaning his weapon; however, the executive officer noted that the magazine was still in the weapon and there was no cleaning equipment near the applicant at the time of the incident. The applicant requests correction of his DD Form 214 to show he was awarded the Purple Heart. His records are void of evidence and he...

The applicant requests, in effect, reconsideration that his records be corrected to show that a Soldier intentionally shot him in the abdomen during his foreign service tour in the Republic of Vietnam and then award him the Purple Heart. The applicant states, in pertinent part, that he was not injured by an accidental discharge from a rifle on 13 January 1968 as reported through military medical and personnel communications while serving in the Republic of Vietnam. Army Regulation 600-8-22...

I certify that hereinafter is recorded the record of consideration of the Army Board for Correction of Military Records in the case of the above-named individual. The DA Form 1577 showing the applicant is entitled to the Purple Heart is new evidence that requires Board consideration. Army Regulation 600-8-22 provides, in pertinent part, that the Purple Heart is awarded for a wound sustained while in action against the enemy or as a result of hostile action.

APPLICANT STATES : In effect, that he is aware that he was "accidentally" shot by another soldier but contends that he was wounded the day after an Army general was captured by enemy POWs (prisoner of wars). The fact that the applicant's injury was determined to have occurred in the line of duty is not evidence to support an award of the Purple Heart. There is no such evidence in the applicant's case.

Application for correction of military records (with supporting documents provided, if any). There is no evidence to show that the FSM or his unit was actively engaged in combat with the enemy at the time of his accidental wounding, nor is there evidence showing his weapon was fired with the intent to inflict damage or destroy enemy troops. Absent any evidence confirming the FSM was ever wounded in action as a direct result of enemy action, or recommended for or awarded the PH by proper...

There is no evidence of record that shows he was injured or wounded as a result of hostile action or that he was awarded the Purple Heart. Army Regulation 600-8-22 (Military Awards) provides that the Purple Heart is awarded for a wound sustained in action against an enemy or as a result of hostile action. In this case, the evidence of record shows the applicant was involved in an accidental discharge of a weapon by another Soldier and he later received treatment for this injury.

Application for correction of military records (with supporting documents provided, if any). He claims he tried to get documentation related to this award; however, military records were destroyed in a fire at the National Personnel Records Center (NPRC) and he has been unable to do so. This case is being considered using a disability retirement packet pertaining to the FSM that remains on file at the NPRC.

However, the transcript of the Physical Evaluation Board (PEB) held on 13 March 1952 shows the record was corrected to show "Line of Duty - Yes" based on a report dated 12 March 1951. They have filed an appeal with the Executive Director, Arlington National Cemetery, based on errors in the FSM's record, but they would like to have the FSM's records corrected to show he was entitled to the Purple Heart. His record is void of documentation showing he was awarded the Purple Heart.
