THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that his records be corrected to show award of the Army Commendation Medal and the Combat Infantryman Badge.

2.  The applicant states he was issued the Combat Infantryman Badge while overseas.  Upon separation he was asked for proof and he didn't have his certificate, so this award was not on put on his separation document.  He further states he needs the corrections to prove his deployment.

3.  The applicant provides no supporting documentation.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 3 March 2004, completed training, and was awarded the military occupational specialty (MOS) 11B (Infantryman).  He also completed airborne training and was awarded Special Qualification Identifier "P" to show he was parachutist qualified.  

2.  The record shows the applicant served with C Company, 2nd Battalion, 504th Parachute Infantry Regiment.

3.  The record contains a copy of an Army Commendation Medal certificate showing that, in accordance with Headquarters, 504th Parachute Infantry Regiment, Forward Operating Base Salerno, Afghanistan, Permanent Orders Number 005-032, the applicant was awarded the Army Commendation Medal for meritorious service from 13 April 2005 to 12 April 2006.
4.  The applicant was discharged on 21 November 2006 in accordance with Army Regulation 635-200, paragraph 14-12c(1), by reason of misconduct (AWOL [absence without leave]), with service characterized as general, under honorable conditions.

5.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) lists his awards as the National Defense Service Medal, the Global War on Terrorism Expeditionary Medal, the Global War on Terrorism Service Medal, the Army Service Ribbon, the Overseas Service Ribbon, and the Parachutist Badge.  It also shows in Item 18 (Remarks) the entry "Service in Operation Iraqi Freedom (Afghanistan) 20050410 – 20060410)."

6.  Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Combat Infantryman Badge is awarded to Soldiers who have an infantry military occupational specialty (MOS).  They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental or smaller size.  Campaign or battle credit alone is not sufficient for award of the Combat Infantryman Badge.

DISCUSSION AND CONCLUSIONS:

1.  The applicant was awarded the Army Commendation Medal on 12 April 2006.  This award was omitted from his DD Form 214.  Therefore, it is appropriate to correct the record to include this award.

2.  The applicant has not provided and the record does not contain any documentation showing the applicant was awarded the Combat Infantryman Badge or that he participated in active ground combat under qualifying conditions.  Therefore, there is no basis for award of the Combat Infantryman Badge or to add it to his records.

3.  The applicant's DD Form 214 currently lists his deployment to and service in Afghanistan.  Therefore, no additional notation is warranted.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the Army Commendation Medal to the list of awards already shown on his DD Form 214.

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to award of the Combat Infantryman Badge or additional notation of his deployment to Afghanistan.
