THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that her Operation Iraqi Freedom service be listed on her DD Form 214 (Certificate of Release or Discharge from Active Duty). 

2.  The applicant states that she was deployed to Iraq from Germany and was unaware that her tour in Iraq was supposed to be listed on her DD Form 214.  She also states that she was injured in Baghdad in July 2003.

3.  The applicant provides her DD Form 214 in support of this application.

CONSIDERATION OF EVIDENCE:

1.  The applicant's records show she enlisted in the Regular Army on 9 May 2000.  She completed basic combat and advanced individual training and was awarded the military occupational specialty of unit supply specialist.  The highest rank she attained while serving on active duty was private first class/pay grade 
E-3.

2.  The applicant's DD Form 214, item 12f (Foreign Service) shows no foreign service.  Item 18 (Remarks) has no entry showing deployed service.

3.  The applicant's DD Form 214 shows she was discharged on 18 November 2005 under the provisions of Army Regulation 635-200 (Personnel Separations – Enlisted Personnel) with an honorable characterization of service after  completing 5 years, 6 months, and 10 days of active service.
4.  The purpose of the DD Form 214 is to record active military service and other pertinent data regarding that service normally needed to verify military service for benefits, retirement, employment, and membership in veterans' organizations.

5.  Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214.  In pertinent part, it directs that foreign service performed during the period covered by the DD Form 214 will be entered in item 12f.  The regulation also states that the amount of foreign service will be taken from the Soldier's Enlisted Qualification Record or, if necessary, verified from the Soldier's Military Personnel Records Jacket.

6.  This regulation further provides, in pertinent part, that when an active duty Soldier is deployed with his or her unit during the period covered by the DD Form 214, an entry will be made in Item 18 to show "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD – YYYMMDD)."

7.  In the processing of this case the Board's staff contacted the Defense Finance and Accounting Service which established that the applicant received imminent danger pay in Southwest Asia (Kuwait) from 1 March 2003 through 31 October 2003.

8.  On 16 December 2008, in response to an e-mail inquiry from the staff of the Board, the applicant stated that she was deployed from the end of February to 
8 July 2003, when she was injured and sent to Walter Reed Army Medical Center.

DISCUSSION AND CONCLUSIONS:

1.  There is no evidence in the available records showing applicant served overseas in Southwest Asia.

2.  Although the Defense Finance and Accounting Service records show the applicant received imminent danger pay during the period 1 March 2003 through 31 October 2003, there is no evidence available indicating exact beginning and ending dates of that foreign service.  Imminent danger pay is given in full months. 

3.  The applicant's statement that she served in Iraq from the end of February until 8 July 2003 does not coincide with the Defense Finance and Accounting Service information provided.

4.  Deployment and foreign service entries on a DD Form 214 show exact dates and the exact amount of time.  Since there is no evidence to show the exact dates the applicant served in Iraq, there is insufficient documentation on which to grant the applicant's request.
