		IN THE CASE OF:

		BOARD DATE: 21 January 2009

		DOCKET NUMBER: AR20080016063

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that he be shown to have been authorized the Combat Medical Badge.

2. The applicant states he was awarded the Combat Medical Badge in June 2006 but never received orders for it nor was it noted on his Enlisted Records Brief (ERB).

3. The applicant provides no supporting documentation.

CONSIDERATION OF EVIDENCE:

1. The applicant enlisted in the Regular Army on 8 April 2004, completed training, and was awarded the military occupational specialty 68W (Health Care Specialist).

2. He is shown to have served in Iraq from 5 March 2005 through 16 February 2006. There is no evidence of record to show what type of unit he was assigned to while in Iraq.

3. He was honorably discharged from active duty on 5 August 2008. His DD Form 214 (Certificate of Release or Discharge from Active Duty) lists his awards as the Army Commendation Medal, the Army Achievement Medal (2nd award), the Good Conduct Medal, the National Defense Service Medal, the Global War on Terrorism Expeditionary Medal, the Global War on Terrorism Service Medal, the Noncommissioned Officer Professional Development Ribbon, the Army Service Ribbon, the Overseas Service Ribbon, and the Driver and Mechanic Badge with "S" (special mechanical equipment) operator clasp.

4. The record contains no indication that the applicant was recommended for or awarded the Combat Medical Badge.

5. Army Regulation 600-8-22 (Military Awards), paragraph 8-7b(4)1, provides that on or after 18 September 2001, medical personnel assigned or attached to or under operational control of any ground Combat Arms unit (not to include members assigned or attached to Aviation units) of brigade or smaller size who satisfactorily performed medical duties while the unit is engaged in active ground combat, provided they are personally present and under fire, are eligible for award of the Combat Medical Badge.

DISCUSSION AND CONCLUSIONS:

1. The applicant states he was awarded the Combat Medical Badge in June 2006 but never received orders for it nor was it noted on his ERB.

2. There is no available evidence of record to show that applicant served in a unit that engaged in active ground combat and that he was personally present and under fire. He provides no evidence, such as statements from his chain of command, corroborating his contentions and explaining what may have happened to his Combat Medical Badge orders.

3. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.

BOARD VOTE:

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

The available evidence clearly shows the applicant served as a medical specialist in Iraq with the Surgical Shock Trauma Platoon. The DA Form 638, referred to by the applicant as having awarded him the ARCOM, is not filed in his military records. Should he have this document, or be able to obtain it; and if it provides specific evidence showing he served under fire in combat as a medical specialist; he may submit another application for consideration.
