		IN THE CASE OF:

		BOARD DATE: 13 NOVEMBER 2008

		DOCKET NUMBER: AR20080015354

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that his records be corrected to reflect his award of the Combat Infantryman Badge (CIB).

2. The applicant states that at the time of his release from active duty (REFRAD) he did not have a copy of his orders awarding him the CIB; however, he has since obtained a copy of the orders.

3. The applicant provides the back page of permanent orders number 098-102 awarding him the CIB on 24 February 2005 and a copy of his DD Form 214.

CONSIDERATION OF EVIDENCE:

1. The applicant enlisted in Montgomery, Alabama on 9 March 2004 for a period of 4 years and training as an infantryman. He completed his one-station unit training, parachute training and ranger indoctrination at Fort Benning, Georgia and was transferred to the 75th Ranger Battalion at Hunter Army Airfield, Georgia for his first and only duty assignment.

2. He deployed to Iraq from 4 January through 23 March 2005 and from 4 April through 10 July 2007. He was advanced to the pay grade of E-4 on 1 March 2006.

3. Permanent Orders Number 098-102, issued by Headquarters, Joint Task Force, awarded the applicant the CIB effective 24 February 2005. However, these orders are not filed in the applicant's official records.

4. On 8 March 2008, the applicant was honorably REFRAD due to completion of required service. He had served 4 years of total active service and his DD Form 214 reflects that he was awarded the Army Commendation Medal, the Army Good Conduct Medal, the National Defense Service Medal, the Global War on Terrorism Expeditionary Medal, the Global War on Terrorism Service Medal, the Iraq Campaign Medal, the Army Service Ribbon, and the Parachutist Badge.

DISCUSSION AND CONCLUSIONS:

1. The applicant was awarded the CIB by competent orders and it appears that copies of those orders were not properly forwarded for inclusion in his official records.

2. Accordingly, he is entitled to have that award added to his records at this time.

BOARD VOTE:

____X____ ___X_____ ___X_____ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

1. The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing that the applicant was awarded the CIB.

2. The Board wants the applicant and all others to know that the sacrifices he made in service to the United States during the Global War on Terrorism are deeply appreciated. The applicant and all Americans should be justifiably proud of his service in arms.
