IN THE CASE OF:
BOARD DATE: 6 November 2008
DOCKET NUMBER: AR20080014314
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that item 12b (Separation Date This Period) on his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show 27 February 2007 instead of 28 February 2006.
2. The applicant states, in effect, that he was discharged on 27 February 2007.
3. The applicant provides no additional evidence in support of his application.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Regular Army on 28 October 2003 for a period of 3 years and trained as a multiple launch rocket system crewman.
2. Records at the Defense Finance and Accounting Service (DFAS) show the applicant was released from active duty on 28 February 2007.
3. Item 12b on the applicants DD Form 214 shows he was released from active duty on 28 February 2006.
DISCUSSION AND CONCLUSIONS:
Although the applicant contends that he was discharged on 27 February 2007, records at DFAS show he was released from active duty on 28 February 2007. Therefore, item 12b on his DD Form 214 should be corrected to show he was released from active duty on 28 February 2007.

____XX____ ___XX_____ __XX______ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING

BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
a. deleting the entry 2006 in item 12b on his DD Form 214; and

Item 12 shows the Record of Service. The evidence of record shows that after completing 5 months and 28 days in the DEP, the applicant enlisted in the Regular Army and entered active duty on 3 August 2005. Therefore, there is sufficient evidence to correct his records to show his 1 year, 2 months, and 24 days of service in Kuwait/Iraq as 15 August 2006 to 7 November 2007 and to show this period of service in Iraq as his correct period of foreign service.
