THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that her separation document (DD Form 214) be corrected to show the award of the Korea Defense Service Medal.

2.  The applicant states that she did not receive the Korea Defense Service Medal for her service in the Republic of Korea.  She did not know of her entitlement to the Korea Defense Service Medal.  She served honorably for  
2 years in the Republic of Korea and was not awarded the medal.

3.  The applicant provides a copy her DD Form 214, DA Form 2177-7 (NCO Evaluation Reports), assignment order, and a memorandum dated 5 August 1998.

CONSIDERATION OF EVIDENCE:

1.  The applicant's military personnel record shows she enlisted in the Regular Army on 26 November 1982.  She completed the necessary training and was awarded military occupational specialty (MOS) 91B (Medical Specialist).  

2.  She was promoted to pay grade E-8 and served as a 76S (Retention NCO) until she was honorably retired from active duty on 30 November 2002 and placed on the retired list on 1 December 2002.  She completed 20 years and 
5 days of Net Active Service This Period.



3.  The assignment order and memorandum the applicant submitted shows that she was assigned to the 728th Military Police Battalion in the Republic of Korea effective 17 November 1997 and while she was there she received an approved Foreign Service Tour Extension (FSTE) through 13 September 1999.

4.  A Certificate of Award for the Meritorious Service Medal, issued by Headquarters, Eight United States Army, Permanent Orders Number  
231-3, dated 19 August 1999, shows the applicant was awarded the Meritorious Service Medal for meritorious service while serving as a Career Counselor and Senior Career Counselor, with the 728th Military Police Battalion and the  
8th Military Police Brigade during the period 17 November 1997 to 13 September 1999.

5.  Army Regulation 600-8-22 (Military Awards) states that the Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who have served on active duty in support of the defense of the 
Republic of Korea.  The area of eligibility and period of eligibility are as follows:  (1) the area of eligibility encompasses all land area of the Republic of Korea, and the contiguous water out to 12 nautical miles, (2) all air spaces above the land and water area.  The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that her DD Form 214 should be corrected to show the award of the Korea Defense Service Medal.

2.  Evidence shows that the applicant served as a Career Counselor and Senior Career Counselor with the 728th Military Police Battalion and 8th Military Police Brigade during the period 17 November 1997 to 13 September 1999 in the Republic of Korea.  Therefore, she is entitled to correction of her records to show the Korea Defense Service Medal.
