THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests the addition of the Army Commendation Medal and the Combat Action Badge to his DD Form 214 (Certificate of Release or Discharge From Active Duty).

2.  The applicant states he was awarded the Combat Action Badge on 15 October 2005 and the Army Commendation Medal on 7 March 2006.

3.  The applicant provides:

	a.  His DD Form 214 showing he was awarded the Army Achievement Medal, Reserve Components Achievement Medal, National Defense Service Medal, Global War on Terrorism Service Medal, Armed Forces Reserve Medal, Noncommissioned Officer Professional Development Ribbon, Army Service Ribbon, Overseas Service Ribbon, Armed Forces Reserve Medal with "M" Device, and the Parachutist Badge.

	b.  Permanent Orders Number 288-213, Headquarters, 3rd Infantry Division, Iraq, dated 15 October 2005, awarding the Combat Action Badge for engaging or being engaged by the enemy on 14 September 2005.

	c.  Permanent Orders Number 061-32, Headquarters, 322nd Civil Affairs Brigade, Iraq, dated 7 March 2006, awarding the applicant the Army Commendation Medal.


CONSIDERATION OF EVIDENCE:

1.  The applicant is a US Army Reserve (USAR) master sergeant serving in MOS (military occupational specialty) 38B (Civil Affairs Specialist).  He served on active duty in support of Operation Iraqi Freedom from 10 June 2005 to 10 May 2006.

2.  The applicant was issued orders awarding him the Army Commendation Medal and the Combat Action Badge.

3.  Army Regulation (AR) 600-8-22 (Military Awards) sets forth Department of the Army criteria, policy and instructions concerning individual military awards.  It provides that award of the Iraq Campaign Medal is authorized for service in direct support of Operation Iraqi Freedom on or after 19 March 2003 to a future date to be determined by the Secretary of Defense or the cessation of the operation.  The area of eligibility encompasses all land area of the country of Iraq and the contiguous sea area out to 12 nautical miles and the air space above these areas.  To qualify for award of this campaign medal, service members must have been assigned or attached to or mobilized with units operating in these areas of eligibility for 30 consecutive days or for 60 non-consecutive days or meet one of the following criteria:  a) be engaged in combat during an armed engagement, regardless of the time in the area of eligibility; b) be medically evacuated from the area of eligibility for wounds or injuries resulting from participation in an operation or official duties; or c)  participates as a regularly assigned air crewmember flying sorties into, out of, within or over the area of eligibility in direct support of the military operations [each day of operations counts as one day of eligibility].  This campaign medal may be awarded posthumously.

4.  During the applicant's service in Iraq, there were two named campaigns – Iraqi Governance (29 June 2004 – 15 December 2005) and National Resolution (16 December 2005 – Date to be Determined).

DISCUSSION AND CONCLUSIONS:

1.  The applicant requests the Army Commendation Medal and the Combat Action Badge be added to his DD Form 214.

2.  The applicant has orders awarding the Army Commendation Medal and the Combat Action Badge.  These awards/badges should be added to his DD Form 214.

3. The applicant served in Iraq in support of Operation Iraqi Freedom.  He should be awarded the Iraq Campaign Medal with 2 bronze service stars.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected:

	a.  Awarding him the Iraq Campaign Medal with 2 bronze service stars; and

	b.  Adding the Army Commendation Medal, Iraq Campaign Medal with 2 bronze service stars, and the Combat Action Badge to his DD Form 214.
